man you are very pateint. i love dogs but would have prob had to throw finley crushed glass mixed in with ball of groundbeef up there which would have painlessly killed him very fast. would be a shame though because it is not the dogs fault but obvious that he gets no attention anyway so what kind of life is that. oh and after that scumbag lawyer acted the way he did it would have been on, i would not beat his ass as he would sue you but many things can be done in secrect to make his life hell.
Have you had any results from the hearing yet? I'm sorry to hear that you've had to put up with this awful noise, and worse...try to do your job while sleep deprived because of it. When I was being severely sleep deprived because of my neighbor's barking dog I was afraid to drive. I felt like I was in a fog & my brain kept wandering. I also caught myself falling into microsleeps. Sleep deprivation almost killed me, & when I had to drive it could have also killed someone else.
Good point to bring up about you transportation job, I am also under "hours of service" guidelines. I have the same problem with backyard neighbors. Thier viciouse dogs bark at me through he chainlink fence. Dogs charge at me to attack while i am in my backyard.. Not a word to their dogs, even when they are present in there backyard.

For those who don't know about "hours of service", it is a federally mandated requirement for certain workers to be well-rested and alert when reporting for duty. There may be a written complaint procedure in your city, as there is in Los Angeles. I used to call the police, with no results. In fact, my first call to the police about the dog was March 5, 2007 at 4:15 AM. Nearly 4 years ago, as of today's date! It has been a long and agonizing process.
The hearing is over, and the Hearing Officer has 30 days to reach a decision. It was an extreme ordeal.
The dog owner, who it turns out is an attorney, arrived about a half hour late. He referred to my video as "allegations" throughout the hearing. He still said I was making the whole thing up. (As if I would go to all this trouble!). He lied under oath; said his dog was inside his house every night. Arrogant, filibustering, he openly mocked my job and my mentions of sleep deprivation.
He said, "Have you ever had any reprimands about being sleep deprived at work?" I said, "We don't get reprimands. We get train wrecks." He said, "Well, have you had any train wrecks?" I guess he plans to let his dog bark until I have a train wreck. I said, "All I want to do is sleep at night so I can be rested for work." He said, "I don't think she works at all; I see her at home every day. I said I work two overnighters so I can sleep in the hotel. He said, "If you believe that!"
I had a petition, "To City of Los Angeles Animal Services: Please, I don't want to hear the Barking Dog of (his address), between the hours of 8 PM and 8 AM." It was signed by seven of my neighbors. He said, "And I don't want a garbage truck to come to my house and dump garbage all over my yard. This doesn't mean anything." He said he had built a new deck for the dog, closer to ground level. I said, "Now the dog is even closer to my house." He said, "Yup."
He said, "This woman is a complainer; that's what she does." He said he had notes from all his neighbors, written by me, complaining about their dogs. I said, "Prove it. Let's see them." He said he had them at home. I said, "This is the hearing. Now would be the time to present your evidence." The Hearing Officer said, "Yes, this would be the time." Of course there are no notes.
It want on like this for over an hour. I was exhausted by the end of the hearing.

I feel bad for the dog and I am sure the owner "might" mean well, but the reality is that no neighbor should be subjected to this all day long. Everyone is entitled to some form of peace and quiet. Some noise sure, but all day and some of the night every day??? Absolutely ridiculous!
Passenger Engineers have a safety critical position that requires good rest. The owner of this poor dog needs to consider how he would feel if he or his loved ones were passengers in an airplane or passenger train knowing the Pilot or Engineer had little or no sleep.
@Larfe10 Absolutely! Nobody would get on a bus, train, plane, or any type of public transportation if he or she thought the driver was less than 100% fully rested and focused on the task at hand. I plan to emphasize this at the hearing. As it stands now, as soon as I get home, no matter what time of day, if I don't hear the dog, I'll go to bed immediately and take a nap. I'll be awakened several times during the night, but maybe that nap will add enough to the day's total.
I would certainly want the Engineer of a passenger train well rested and not fatigued. This owner is clueless to the needs of this poor dog and on how to be a decent neighbor.

Wow .. you may want to pound on a couple of neighbors doors. You CAN NOT be the only person losing sleep because of this dog. If you go to court with a bunch of letters from other neighbors, it won't be your word alone against its owner. Good luck. Oh btw ... I have a dog that wants to bark and use an electronic bark collar on him, it works immediately and is not inhumane as some people think.
@MrMichaelAmick Thank you. The dog owner already knows his barking dog is creating a nuisance, so there's little chance he would want to get an electric collar for the dog. This will be my second hearing. I had a hearing in Dec. 2009, and the dog owner was there. He denied everything. He lied to the Hearing Officer. He said the dog was inside his house every night. That's why I bought the camcorder: for the sole purpose of making this video to submit as evidence.
This is just not fair to the dog & the neighbors. I feel so bad for how unhappy & sad this dog must be to be left alone all those hours. He doesn't deserve a life like this. Nobody does not even a dog.

As for me, I work in the public transportation industry, and there have been times I had to work on little or no sleep because of this dog's barking. During those times, I was petrified of making a potentially disastrous mistake at work. This will be my main focus at the hearing for a favorable resolution to this problem for the safety of the traveling public.

we in North carolina have a trick for barking dogs. it's called a water hose. after a couple times the dog will stop and water does not hurt the dog.
