  • i know there is a law out there, i dont remember it but if you attempt to pay a bill and they refuse you must offer it again and if they refuse it twice all you need to do is say thanks for paying the bill. because this is a law i remember about paying a credit card or other bills so i wonder if this would be the same for a morgage.

  • I'm tired of people blaming the banks for foreclosures. Guess what, no one is forcing you to borrow from the banks. If you can't afford to buy, then you need to rent. Plain and simple. No one should feel sorry for you getting kicked out of your homes because they're not YOUR homes to begin with. They were the banks.   • The last time they did this they foreclosed on the family farms, the banks owned the land and farms, congress passsed a law forbidding banks from profiteering on foreclosures. And eighty years later they are at it again making money on both ends of taking peoples property.

  • People who default on their debt obligations are the cancer cells of the economy. Foreclosure is the medicine that kills the cancer cells and replaces them with healthy ones (people who are responsible). When cancer cells succeed in fighting for their place, it is the good cells that suffer. I have bought enough foreclosed homes and heard enough stories and insofar every single foreclosue in my book was a result of irresponsibility.

Yes the banks sliced up the debts to package them nicely, but it sold mostly CDS and when that went skyrocket, the banks lost money, lots of it.   • @conworldus The bank did'nt lose the note, they sold it for full value to investors. At most they may have been servicing the loan. They have no legal standing, They securitized these notes and sold them to pension funds. There are no notes to perfect chain of title, this is a critical issue that puts ALL citizens property rights at risk. Perhaps you have not researched this issue deeply enough to understand the full scope of rampant fraud that has taken place throughout the system.

  • @conworldus Banks ran out of good borrowers to sell mortgages, and they were preselling the MBS's faster than they could sign new mortgages, so they started approving bad loans, bundle the bad loans up, get rating agencies to give them AAA rating, sell them to maybe your pension fund, then turned around and bet against them knowing they would fail, making money on them twice. Then we bailed them out, so they got paid a 3rd time, now they want the houses too. got it?

    I hope they lose.

Turns out that if you can prove someone sold you crap, and told you it was gold, you can make them buy it back. at least that will be the case here, because its in the contract between the bank and the investors.   • @pherronii The bottomline is the ones who are losing the house are the ones that are not paying. The bank did not hold a gun to their heads to make them take out the mortgage. They did it because of greed and irresponsability. Foreclosure is the only recourse. As for that packaging of securities, banks were the biggest losers. They needed the bailout because they lost money, not because they made money.

  • @conworldus I have zero sympathy for banks - they got bailed out w/ tax payer money, then turned around and sat on it. If politicians are going to bail out banks, they can damn well bail out people too and enact legislation to put a freeze on these foreclosures if people can prove they are looking for work. If you feel it's okay for banks to foreclose on homes, then you should also believe we should have let the banks burn when THEY were irresponsible.

  • Get the bank to PROVE where the funds came from and I think you'll find out that the money actually came from your Birth Certificate Trust Fund account. Therefor you home is already paid for and they don't want you to know this. You actually end up paying the bank back 100% plus interest on money you've already paid off the home with.

  • All foreclosures are based on Fraud. The bank didnt loan you any money. The promissory note is a check. They deposited it into your escrow account, funded the account and paid the seller with the 'money' they created from thin air but they didn't give you a deposit slip showing the deposit.     Bank b{wells fargo}took over the loan from bank a{any smaller loan co.} Bank b sells the note{monetized the note}to investors{ bank c:bank of china, deutsche bank etc}.

    Now the legal question, who owns the note?

    Wells Fargo is only loan servicing co. now and if they foreclosure on the note, the real owner of the Security Instrument can come after you in 2 or 3 more years.

  • Its actually much deeper than CNN is letting on, the reason the lender can't produce the note is because the lender modified it after both parties signed it. If the produced it, it would provide a case of fraud against the banks. The reason the note is modified after signing is because it must be entered into the banks books as an asset and liability. This double book keeping entry violates GAAP and FASB rules but most banks do it. If the banks say the docs are lost than you know what happened.

The US legal system demands the Lender produce the NOTE and prove it has a right to foreclose. What is difficult for you to understand? This is not about "theft" or paying vs not paying.... This is about protecting the LETTER of the law, not circumventing the law. These people are NOT deadbeats!

  • Hey all you haters, you might want to listen to what she's saying... She wants to Pay Off The Mortgage and They Won't Let Her, and it's looking as if they sold the note and either A. Don't actually know who owns it anymore... OR B. Won't tell her. And just for asking they added thousands of dollars in fees to her balance. This is not a one sided issue.

    P.S. I do not condone theft either, but that goes both ways in situations like this. Extortion for asking who owns the house is theft too.

They wanted to take all the profit, and now they want the public purse, through the federal government,to absorb all the risk.
