  • Read the Law that the officer is talking about 36 CFR 7.96. You are on National Park Service grounds and there are exceptions to your right to assemble. You need a permit if you intend on drawing a crowd (which you are if you are shouting). It's for your own safety and the safety of the visitors. There are streets where you are allowed to protest listed on the website, fascist nut jobs.

    Actually, you're wrong. The National Park Service has special privileges in the District and neighboring Maryland and Virginia. If you live in DC (like I do), you know that you don't mess with the Park Service. They are constantly on the lookout for terrorists to strike the capital's monuments. Thus, under the 36 CFR 7.96 you cannot assemble and draw a crowd without a permit. It's for everyone's safety and allows the police to do their job. You guys don't even know what Socialism is

  • Henry, you get permits from the city not the police. If you listen to the video, the cops had no idea the other protesters had a permit until they asked them.

    Permits exist to limit demonstrations, not benefit demonstrators.

    Requiring police to attend every demonstration in case there is a fight is like having a cop sit on your doorstep in case your robbed, its unnecessary, a waste of tax dollars, and a waste of law enforcement's time.

  • I can't believe the "Young American for Liberty" didn't know that you can't demonstrate on Capitol grounds. I think I discussed that in my entry level poli sci class freshmen year. There are plenty of great spots to demonstrate in DC where people will see you. And if that's not good enough, get a permit.

    Young Americans for Liberty should research that kind of thing first. The club shouldn't only consist of poster coloring time and attempting to scare a veteran cop who knows the rules.

    The actual law states that if you have over 25 people actively involved in your demonstration you must have a permit. This has nothing to do with being at the capitol. They were within their rights and their rights were violated. Next time do your research before you comment. And the group leader was right, the 1st amendment protects free speech and states the NO laws may be made abridging it so all laws restricting speech are unconstitutional. Read your constitution.

  • Bill of Rights regards the Rights of the States, and is to protect their rights from being infringed upon by the federal government. Under a literal interpretation of the Constitution, the Bill of Rights does not protect the rights of individuals from the federal government. They were on federal land, so according to a literal interpretation of the Constitution, they had no guaranteed freedom of speech.

  • The explicit purpose of Amendments 1-9 is to protect the rights and liberties of individuals from encroachment by any governmental body, be it federal, state or local. If it weren't for the Bill of Rights, which is apparently what your historically inaccurate and utterly retarded argument suggests, we would be living in a dungeon...

    ...and just because you happen to be on federal land doesn't mean that your rights, which are protected by a federal document, vanish.

  • So now we can argue as to if their right to peacefully assemble was abridged or not. This can be argued for or against easily.

    For: Their right was abridged as it was limited in the scope of anytime/anywhere

    Against: Their right was not abridged, as the permits don't get denied, and are there to alert local authorities of the protest. Such alerts are needed so that authorities can create detours for any traffic that might interrupt the event, or for other safety reason.

  • Next time, remember to buy a permit. It isn't like they would've denied him his permit, the government just has to know people aren't using Federal land for hate speech or inciting a riot or something of that nature.

    It just seems like this group is blaming it's lack of proper planning for a demonstration on the establishment rather than their own failure to know proper procedures.

  • I tend to think the lack of planning was intentional since nothing helps these groups attract members like this sort of theater.

    Either that or they only have a superficial grasp of constitutional law. Reasonable restrictions on rights have always been acknowledged.

  • You guys need to brush up on your Constitutional Law. The Supreme Court has long upheld reasonable content-neutral restrictions on free speech, including requiring a permit to protest. They're called time/place restrictions, and as long as the permits are given without consideration to the subject matter of the speech, a permit requirement for a protest has been upheld as constitutional and not an unreasonable burden on Free Speech.

  • They weren't arrested for speking their mind or assembling peacefully. They were arrested for protesting w/o a permit. The officers asked for a count of participants. The government has a duty to protect the public at large (including the protesters), and prevent disruptions for everyone else, particularly in a city like DC where everyone wants to protest. The government has to weigh the needs of everyone. There's nothing fascist about it, unless they're only stopping one viewpoint.

  • Following orders yes. Doing his job, no. Police (and SWAT) swear an oath to obey and uphold the Constitution, and obstructing these peoples free speech and right to peaceful assembly by citing some lame C.F.R code (not a law, a code) goes against that oath.

    The Constitution (and Bill of Rights) were written to protect us from the abuses of government, as soon as people wake up and realize that and stop simply 'following orders' then maybe we can reclaim our lost liberties.

  • First off, that is not a SWAT team. Those are just officers. Secondly, if they had obtained the proper permit in the first place there would have been no problem.

    The reason a permit is required on federal ground is to ensure that the protest is properly organized and does not break out in a riot. In that respect, it is safety issue, not an infringement. However, if a permit were denied due to the intent of the protest, /then/ there would be reason to be upset. Dillion just did his job.

  • The US Constitution is the highest law of the land dumb ass. The requirement for a permit is actually unconstitutional and would require an amendment to the constitution. Things like permits are designed to erode liberties. Stay in Australia. We don't need more people here supporting tyranny.   • No, it's not about where the line needs to be drawn...The line is between our rights and liberties and the Government, and that line is the Constitution. It is not to be crossed!

    Nowhere in the Constitution does it say we need a permit to exercise our rights of free speech and peaceful assembly, so the CFR code is rendered useless, since it tries to affect these rights.

    His, and all police officers, job is to PROTECT the Constitution, not walk all over it!

  • Yes, that's the excuse the government uses, and it's BS. The possession of a permit does not prevent a riot. This not about safety as much as it is a government that does not like criticism.

    If begging permission from the government to peaceably assemble require' one to divulge their name or that of their organization, it runs afoul of the constitution.

    Their real motivation is plain. They want know what you're protesting before "granting" you the freedom to do so.
