Judge Napolitano is under the erroneous impression that the Supreme Court has supremacy over the other two branches of government. This is not correct; the Constitution of the United States (Article II Section III) explicitly allows the Congress to prevent the Court from ruling or hearing certain cases, and it has the right to abolish courts (other than the Supreme Court). The Constitution nowhere gives courts the power that Napolitano seems to believe that courts and judges claim and exercise.

The people can vote on an issue only if the issue is considered vote-able. No one would be up for that, time, money or effort on the judge OR minors part. The word "homosexual" was added to Timothy. Prior to the 1970's, the word "malakois" which is hebrew for "effiminent altar boys" was re-interpreted to mean homosexual.

Did you know that in Hebrew, there was no word to describe "homosexual". Therefore, it cannot be in the Bible.

But theists interpreted this and said "it means homosexual" even though Hebrew scholars contest this and said "we don't have a word for homosexual and the word you are transcribing (malakois) doesn't mean homosexual.

So you see, people revised the Bible to make it appear God was against homosexuals.

The tory of Sodom and Gomorrah (spelled it incorrectly I bet) has been misinterpreted. Now, personally, the Bible could say "damn all the homosexuals" and I could care less. I am not a Christian. I do not accept the Bible as the word of god or any god because there has not been any proof to a gods existence.
