There're offshore gambling boats but they all go at least 1 mile off shore because that is when maritime jurisdiction of the state ends and maritime jurisdiction of the federal government begins. In almost all states (New York Included) gambling is illegal, therefore it is illegal when you are in the state jurisdiction of New York but gambling is not illegal according to the Feds, so it is O.K. if you aren't in state water.

@Spawnz0t good q, it could be legal for one of these two reasons, 1) it is possible Louisiana is one of a couple of southern states that have amendments to their gambling laws to permit offshore gambling as an attempt to increase tourism, i know for a fact this is true in Mississippi but not sure on Louisiana. 2) I don't know where the Argosy is but if it goes on the Mississippi river it is legal because the Feds control the Mississippi because the states all around it fought over who got it.
