When does being old or a senior citizen allow you to be above the law? I have seen plenty of cases where an old person/ senior citizen have killed Officers and or people cause they were underestimated and people became complacent around them. Officers are held to strick policies. Even if an Officer believes a certain use of force, for example the Taser, is not something he wanted to do, he is still obligated to follow the policies and procedures of his Department. Just because she is 72, doesnt mean she is above the law. She refused to follow verbal commands and resisted arrest. People can bad mouth that cop all you want, but ultimately he had to do what he had to do. There is two sides to ever story, make sure you gather both.

How much longer before someone questions the legality of forcing someone to sign something that they do not fully understand ? Several States have requirements that the issueing officer must make sure that the offender FULLY understands that his signature is NOT an admission of guilt . Other States could write ANYTHING they want on the ticket and FORCE you to sign it . What's wrong with this picture ?

Officers are held to strick policies. Even if an Officer believes a certain use of force, for example the Taser, is not something he wanted to do, he is still obligated to follow the policies and procedures of his Department. Just because she is 72, doesnt mean she is above the law. She refused to follow verbal commands and resisted arrest. People can bad mouth that cop all you want, but ultimately he had to do what he had to do. There is two sides to ever story, make sure you gather both.

I must say that I am torn by this situation. First the cop did not have to do that, but the woman should not act and talk to a cop like that also. If we want to get it right, we must be calm and talk to our public servants with respect and be professional. On the other hand, the cop was not that professional either. So, both party share the blame in this scenario.

How much longer before someone questions the legality of forcing someone to sign something that they do not fully understand ? Several States have requirements that the issueing officer must make sure that the offender FULLY understands that his signature is NOT an admission of guilt . Other States could write ANYTHING they want on the ticket and FORCE you to sign it . What's wrong with this picture ?

I just googled Kathryn Winkfein and looked for articles dated 6 October 2009 . The county is lucky she settled , the Sheriff of Travis County was dis-satisfied with the procedures used by the Deputy Constible .

a tazer should be last resort (next to the officers weapon) but at the same time, if he says hes going to do it she should have listened.

I'm so tired of people defending criminals and not defending cops. They do what they do to protect the people. All she had to do was sign the ticket and she would have been on her way. It's her own fault. Good for the cop, if she would have got hit by a car when she went back to her truck he would have looked bad for letting her go. Just because you're 72 doesn't give you the right to not obey the law or a cop.

They might try to say that's procedure but that's not procedure. If an officer already has a persons information its "procedure" on the side of a busy highway to let a person with a fine leave if they resist, and then issue a warrant for their arrest. This is clearly misuse of excessive force, disregard for public safety, and disregard for procedure.
