However, the allowance of tricking kills it totally. What's the sense of excluding magic while tricking is allowed? The usage of the former, esp. in NUR+ conditions, gives the gamer far less advantage over the foes than using game errors.

He really didn't have much of a role in creation of PAIN. The primary start of myself (and others) looking into the idea was an older TUGOWU user (it's really not that inspired an idea but fun)

As said previous, Shinobier had little to do with the PAIN run being formed (which is just a One-___ run, NCR *NER+NRR* + NUR+ *NUR+NER* and 'No Magic' *usage*). In GoWII we opted to take down 'Relics' for "+" conditions. This isn't so much an overall option in the case of GoW1 or CoO in the same sense so they lack the distinction. We felt it was TOO important that NCR, No Magic and Blades ONLY be kept as the basics to take one away for a 'non-plus'. Thus the relic stipulation was used.

Tricking is a fine exploit.  It's also an accomodation to the "+" run of GoWII. GoW1's tricking doesn't require whipping out a spell (without any spending or offensive application)...rather we abuse Artemis in that case. CoO lacks the option, but isn't terribly tough anyway.
