That is because you must have allodial title on the land in order to do with it as you please. When people buy a home they ordinarily buy the home itself, not the land it sits on. Even if you "own land" it is most likely not in allodial title in which case the government can say to do with it what they choose. Unless you have allodial title, your land is subject to imminent domain.

I agree that arresting someone for a manicure is ridiculous but the laws are there to protect us, thanks to those laws is why you can no eat meat without worrying about rat hair being in there and can go to a doctor and be certain they aren't going to kill you.

Ron Paul talks about this kind of thing. Big govt. up our asses when they need to stay the hell out. We're no longer free. Not truly free, no. No other candidate talks about civil liberties being taken away. So sad that most Americans either don't know about Dr. Paul or just don't care about their freedom as much as they say they do. So let's go ahead and put another person in there who is campaigning to get a job for at least the next 4 years.

We can change these types of state law. NY outlaws massage without 2 years of training, and that's dumb too. CA only requires `50-100 hrs. of training and how many people do you hear of dying from their massages? In other states its unregulated.

That's a little different to a business, and wouldn't be seen as a disturbance of the peace. There is no protesting, no exchange of finance, no one claiming that they are skilled in something they are not. But I get your point - where do they draw the line?

I think there is a difference between someone who is openly declaring themselves as unlicensed and someone who is practising as a 'professional' yet is unlicensed. Ultimately it is about skill and service. After all a license is only a piece of paper. Even comparing my physicians there is a world of difference when it comes to skill/knowledge. But practising in a public place (I know it was a protest) might generate something of an eyesore when you have every 'man and his dog' setting up shop.

When I was young, you could start any kind of business you wanted. You could build a house without permission from any government agency. That was in Texas. Twenty-something years ago, my dad had to give up his hearing aid business because of new licensing laws. He was very good at it, and never had a customer complaint. It only gets worse.

It gets worse, I'm not familiar with the code in question here, but in some jurisdictions there is no distinction between whether the hands are those of others or your own.
Cutting your OWN nails is performing a manicure without a license - and thus a crime.

I like very much how that one person in the clip framed it as a matter of consumer rights. Too often, people look at licensing schemes as ways to "protect" consumers from "rogue" businesses, rather than protecting the real rogues from competition. In fact, this diminishes the rights of consumers to contract with whomever they wish. Heaven forbid, how did mankind make it without government? And heaven forbid if we actually got rid of medical licensing, so that people can get cures for cancer.

Think on this: each year over 75,000 pages of new codes, regulations, laws are added to the Federal Register alone. First, it is humanly impossible for any one person, group of people or agencies to know all those codes, laws and regulations...so why have them? They create jobs, useless bureaucratic jobs while making life for the rest of us more complicated.

Some Free State. But on the other hand, if the cops have enough free time to arrest an unlicensed manicurist, things must be relatively peaceful in NH. You could perform unlicensed brain surgery on a sidewalk in Los Angeles and nothing would happen, except you'd definitely get a parking ticket.

On one hand they are trying to protect against diseases, on the other hand it is completely ridiculous for someone to be arrested for doing it on a WILLING participant.
People need to be able to make choices about what they do. This is another 'victimless' crime. If I choose to go to a non-licensed facility, I know the risks. People don't need to be babysat all the time.
