Right, but you can not equate freedom of speech or freedom of the press with the media. I think that is where you are wrong. When the first amendment was formed it said 'freedom of the press', which back then all they had were newspaper reporters. Thus, the FCC can regulate television media and due to the fact that youtube is a private internet site it can be regulated by its owners. Example: can you go to a Catholic HS and say F--- Jesus? No, because it's private property, as youtube is.
I agree with you. Problem is, if you tell them the truth, they will not believe you until their denial is gone. I mean, people have issues about it all. We can't change that. *sigh*
Thing is, YouTube is a private enterprise, not a public forum, so, they can legally regulate whatever they want however they want whenever they want--and yeah, you're damn cute :-)

flagging is done by the viewers, right? so it's not entirely youtube. it's down to the viewers to judge a video to flag. idk. correct me if I'm wrong

The flag is put up by the viewers, but a team of Youtube staff review the video and deem it necessary to confirm your age. They regulate it.
