Fair comment, when does a swarm become a nucleus? This one was collected a couple of days previously and temporarily housed in the travelling box shown, on a mix of foundation and drawn comb. What you are watching is the transferring of that colony into its permanent hive.
Technically not actually a swarm I agree, but not what I would call a nucleus either as it obviously did not have brood of all ages present.
