  • A large corporation may not come after you physically, because it may be against the law.But :You may owe a tradesman or small local business and they may not be overly concerned about the law. They may come and remove the goods that have not been paid for,. Read the small print on the invoice about who still owns the goods.

    As a sole trader I take back the goods that have not been paid for.I use whatever force is necessary, I bring witnesses and a video camera.

  • @actioncomet - Do you extend credit? Do you allow customers to take possession of goods that are not yet paid for, and which you sometimes have to reclaim?

    When a customer uses a credit card, the card issuing bank creates "money" out of thin air by establishing a credit limit for the card holder, and then debiting that credit limit when it issues payment to the merchant. No merchant ever comes after anyone because the goods HAVE been paid for by newly created (inflationary) fiat currency.

  • They seem to try about three or four more times, and usually with different callers.  Eventually they realize that they will get nowhere with me. But then they sell the debt to some other bottom feeder and it starts all over again.

    So I have the minimum local phone service on the land phone line, and I put it in a spare bedroom with the door closed, and the ringer turned down and I let voice mail take all the calls. I only toy with them when I'm in the mood. Otherwise I just delete 'em all

  • We now have MagicJack and use it for all outgoing calls. No one has that number except friends and family. When a voice mail comes in to the MagicJack number, I get an email with an attached sound file, and the email tells me who the message is from, and what phone number it came from. It's wonderful. It works just the way the commercials say it does. We paid $59 in advance for 5 years of unlimited calls anywhere in the USA. The collection calls don't bother us at all anymore.

  • I actually had a collections agent threaten to put a lien against the house i was renting, then told me that i would be sued by the owner to get thier house back. Over a repo that was sold at auction and the balance of $1200 was paid to the finance company one week after they sold the debt. Too funny

    Two days ago, we received a collection letter from a company trying to collect the balance on a motor home that they already repossessed. They took the motor home back over two years ago. Now they've apparently sold the original debt to some 3rd party who's trying to collect the balance after the collateral has already been reclaimed. These bottom feeders will pull anything they think they can get away with.

    ...even after repossession, they can attempt to sue for what they call a deficiency (the difference between what they got for the vehicle at an auction, and the unpaid balance remaining on the vehicle loan agreement).

    BUT, the collectors who wrote to us are trying to collect the entire unpaid balance, with no mention of what they got paid for the motor home.

    BUT they'll have to produce the contract from 1995. I doubt if they still have it.

  • In addition, the Florida Statute of Limitations on written contracts is 5 years.

    First line of defense: require them to produce the original contract (ink signatures, not digital copies, which can be faked).

    Second line of defense: the Statute of Limitations, which begins to run from the last activity on the account. The last activity was in 2004.

    If I didn't know this, I guarantee they'd try to trick me into making an agreement or payment and restarting that Statute of Limitations.

  • don't take this the wrong way but it seems that you are happy encouraging people to not pay their bills, in a financial crisis that is very irresponsible

  • Actually, I believe that fighting back against the debt collection dragons is one of the only ways we have left to reclaim some of the money that is being ripped from the taxpayers and handed off to international banks and Wall Street thieves.

    The "financial crisis" was perpetrated by the very institutions that are trying to collect these "debts".  For individuals like myself, getting out of the debt trap was a matter of survival. I am not ashamed of learning how to survive this crisis.

  • Thanx Haidi...its hard to find info from the other side...if you know what i mean...most web sites don't give you the real scoop on how to deal with the debt collectors, they just repeat some watered-down stuff from the mainstream media, most of which is on the banks payroll anyway...

  • Did this "thin air" money cause some people to labor to supply your family with non "air" things?

    I understand what the CC companies do, but I don't understand why a smart person like you got involved beyond paying off your non interest debt each month.

  • Stu - I don't believe it costs Fractional Reserve lenders any labor to CREATE the "capital" which is used to pay for goods and services... unless you consider tapping a few keys on a keyboard and making a couple of data entries "labor". If so, it certainly does not compare to the kind of labor required to pay it all back. There lies the inequity.

  • As you know, people sometimes experience serious and unexpected financial reversals which render them incapable of making loan payments. When that happens, they often plunge deeper and deeper into the hole when lenders then impose usurious penalties and raise interest rates sky high.

    That usually leaves just two choices for survival -- bankruptcy or legal self-defense. I don't think bankruptcy is necessarily the best choice for everyone.

  • Heidi, thanks for the hard work. Am am going to be looking for your book as any information I can gain in my fight over just 2 cards. I looked at bankruptcy and it seems to me that it is an admission of guilt so you lose what little property you might have. I would rather have bad credit at this point. IF you have the ability to pay down the road they will happily loan you some computer digits.

    If you bought groceries with plastic, people who grew the food, transported it, etc. are involved.

    You benefited.

    Yet, you are proud that you got away without paying.

    Would you allow me to buy one of your creations and not compensate you?

  • I DID bring up the Federal Reserve. It is the one commercial entity which has been given Congressional permission to create money out of thin air. The Fractional Reserve lending system "pays" for the goods/services that are 'purchased' with plastic by inflating the money supply with vapor money... electronic digits... Automated Clearing House credits to merchants' bank accounts.

    Listen to Murray Rothbard... his lectures are here on youtube. He might get through to you.

  • The credit industry has done a good job of convincing most people that they have "benefitted" from the use of credit... HOWEVER, the resulting inflation has driven prices up, which relentlessly PENALIZES us. We pay for this many times over.

    If you bought one of my creations with "plastic", I would be compensated with inflationary vapor money whether you paid back the legally counterfeited "money" with your personal labor or not... but every "dollar" would have less buying power as a result.

  • We now purchase our produce from a nearby organic farm, and pay with cash.

    We now have only ONE Credit Card, issued by a Credit Union. We pay them faithfully each month. This does not create money out of nothing or contribute to inflation because Credit Unions lend a safe percentage of their depositors' existing savings to other members ONLY.

    Otherwise we use a debit card now. NO MORE Fractional Reserve credit. We have left that system.

    I assume from your comments that you wouldn't touch a FRN or other fiat money.

  • We are forced by Congress and the Fed to use FRNs for everyday commerce. How many merchants do you know who take payment in commodities or gold or silver?

  • Nope. All goods and services were paid for with "money" that was created out of thin air.

  • First rule is change your phone number to an unlisted number. Second rule is always never to confirm as you said who you are. Third Rule is never ever giving or confirming SS#, Mother's maiden name. The FDCPA have been stifled by these rules. They can be counter-sued if they contact a neighbor also. Good one Heidi.

  • Interestingly enough, they somehow got our phone number in spite of the fact that it's been unlisted since we moved to Florida nine years ago! I have to wonder whom they may have called and wormed it out of using some ruse.... there would probably be more calls if it was listed. As it is, we get a call about once a month. I use a caller ID and only bother to pick up strange calls when I see the same number appearing over and over again... then I need to give them some grief, LOL.

  • I too live in Florida. Why I am here is a long story. If they found out your phone number after changing it to an unlisted number, it was maybe you had either applied for or listed your phone number for something. It didn't have to be for credit either. The ownership of this phone number is not under my name nor my Fathers. And I am with a different phone service provider now. My Father has not been hassled since.

  • Thanks for your input Bruce. We were smart to move to Florida, weren't we? 100% Homestead Protection exists in ONLY two States - Florida and Texas. I prefer Florida.

    And the crooked banking system that creates money out of thin air when it lends credit deserves to lose customers. I won't use any banking institution except a Credit Union. A Credit Union is a cooperative which limits its lending to members only, and the loan funds are an actual percentage of the members' deposits.

  • Credit Unions practice HONEST banking -- the way it USED to be before the Federal Reserve Act was passed allowing those Fed banks to practice their legalized counterfeiting which has inflated the money supply with loan funds that were created out of NOTHING but a book keeping entry.

    ARE WE allowed to create "money" out of nothing and loan it to people at 10-20% interest??? If WE did that, we would be arrested for COUNTERFEITING and thrown in Club Fed.

  • In the US our Federal and State Statutes are all easily found online just by using keywords -- Internet search terms. I believe your laws in Canada are available on the Internet and can be found the same way.
