  • Shouldn't a member of the SJC have a law degree? Is that what the Left has come to? Someone asking questions that have no direct legal barring? Disappointed in my home state (MN) and the Senate. This is serious, let someone who actually knows what's happening conduct it

    I see no reason to give Halliburton a pass on Constitutional grounds whatsoever, insofar as their entire mandatory binding arbitration structure is specifically designed to deny those same rights to their employees.

  • This woman lied, when the time came to put up or shut up, Jones' "gang-rape" claim simply disappeared. DNA evidence showed she'd had sex with one only man, and he claimed it was consensual.

  • @dgl1962 Not precisely true. The doctor who issued the rape kit was a Halliburton employee, turned the kit over to Halliburton and if we believe them, all it showed was one instance of sex. That's not the same as saying it didn't happen. Insufficient evidence is not the same as innocence.

    I don't say she lied, nor told the truth, but you're relying on press releases from the people who stood to lose quite a bit of money if this came to light.

    The amendment is still a good idea.

    How would you like to have a woman make claims against you & your friends of being gang raped, then when she's tested for it shows only the DNA of the one consensual encounter?

    The worst part of all of this is that many women have been raped and had no justice precisely because many women have lied about being raped & subsequent investigations proved it.

    Another reason to keep women OUT of the military & especially war zones.

    I would agree with you that the woman has been characterized as mental. But when it comes to PARTICULARLY Halliburton, you don't think credibility is ipso facto an issue?

    Lack of a murder weapon doesn't make a murder 'disoccur'.

    Insufficient evidence indicates only insufficient evidence. PRESUMPTION of innocence comes with the American mindset.

    Presumption of innocence is afforded to the accused, not the complainant.

    The corporation of Haliburton and their huge contracts at taxpayer expense didn't rape her and they formed a defense like ANY other entity would have if similar charges were made.

    You would also presume a fair and impartial hearing, which she was also denied. Conflict of interest, and all that. ;)

    Some people are very concerned about justice when it comes to those making charges that involve a hated corporation of the left (Haliburton) than those making charges against the right, like Iran Contra.

So, no, I'm not at all as concerned with the women you refer to as I am about any PERSON who gets screwed in a private arbitration hearing.

  • the statistics on success rate of arbitration and going to court are obviously going to be compared like for like - so it doesn't matter if $50 counts as a success or not because they will have used the same quantum for both litigation and arbitration.

I was pointing out to Cuse330Ci that in my experience, people as biased as capierce seems to be from his original comment CAN be blinded by said bias. No matter how one feels about a particular politician, one should be able to see when they are taking a proper stand. Only blindness would prevent it.

The "yes" at the start of my reply was in response to Cuses' rhetorical question ("are you so blinded by partisanship..."), and I can see how a quick scan over all the comments would cause you to think I was saying "yes" as a direct response (i.e., "yes, I am blinded by partisanship! And proud of it!") Somehow I don't think that sort of ironic humour is in the original poster's CV.

It is the people in the company she was with that perpetrated and aided in the perpetration of these crimes. If she did not want to go to arbitration if something happened then she should not have signed the agreement and found another job. Horrible circumstances, deepest sympathies to her.

    This isn't a conservative or liberal issue. Arbitration agreements don't extend to being gang-raped. That's NOT a risk of the job (which is what the agreement covers). If they thought it was, why did they put her in mostly-male barracks when she despite her concerns?

  • Whilst it's true that KBR didn't technically rape the woman, she complained to them about living conditions which certainly facilitated the rape. Moreover, KBR tried to cover up the rape and they kept her locked up, how can you even say that KBR is not responsible.

    She got drugged and gang raped while working for haliburton in Iraq.

    She was not allowed to pursue legal action due to who she was working for - they only allow arbitration. They also locked her in a shipping container for 24 hours to keep her quiet.

    Al Franken later made an amendment fixing this. 30 repubs voted against it.
