read any good history on the ratification of the constitution. the federalist majority argued that the constitution only enumerated powers to the federal government. to add a bill of rights which prohibited powers would imply that the government had powers which were not granted in the constitution, they argued. they were not against these rights they just did not see the need of adding them into the constitution. a lot of these rights were protected in state constitutions
they argued that only culture could really protect these rights, as they had witnessed these rights being ignored at the state level so many times. the antifederalists used the bill of rights issue to try and wreck the constitution, so the federalists allowed a bill of rights only to stop antfederalist attempts at scrapping the orginal constitution, which had powers over tax, and other things, which they did not like. therefore a bill of rights was added only to save the original constitution

the constitution also declares the president the 'commander and chief' of the armed forces. For a military officer to defy president is to defy the constitution. But if you want to cherry pick which parts of the Constitution you want to follow, that's up to you. The second amendment give the right to bare arms...which could include nuclear arms (since it doesn't specify). Would you up hold the right to bare (nuclear) arms? According to the Military Code of Conduct, allows a soldier not to obey the orders of a superior if the order is against the US Constitution, is immoral, or is against the MCC. Remember the oath is for enemies foreign and DOMESTIC. That would include the US President. The Founders did that to King George, and yes nuclear. The 2nd amendment was put there as the last/4th arm of check and balances.
BTW do you know what an amendment is? It a change that's been made to the constitution. To violate the 10th Amendment, you have to assert some exercise of federal power that has exceeded the scope of the Constitution. Where has the federal government exceeded its power?

read any good history on the ratification of the constitution. the federalist majority argued that the constitution only enumerated powers to the federal government. to add a bill of rights which prohibited powers would imply that the government had powers which were not granted in the constitution, they argued. they were not against these rights they just did not see the need of adding them into the constitution. a lot of these rights were protected in state constitutions

they argued that only culture could really protect these rights, as they had witnessed these rights being ignored at the state level so many times. the antifederalists used the bill of rights issue to try and wreck the constitution, so the federalists allowed a bill of rights only to stop antfederalist attempts at scrapping the orginal constitution, which had powers over tax, and other things, which they did not like. therefore a bill of rights was added only to save the original constitution

What about federal laws that tell me I can't own certain firearms or that I cant have more than a certain number of rounds that fit in a magazine? Last I checked "SHALL NOT BE INFRINGED" is pretty clear cut.
I guess I'm just completely off out of my mind though, right? That's why close to 30 states drew up sovereignty resolutions to the government, reasserting themselves as sovereign entities and superceding the U.S. government.

Federal government taking over state rights is a direct violation of the constitution of the United States of America which if not resolved peacefully, has the potential to turn violent. Each state is a sovereign entity and the U.S. government is their agent to assist in defending from foreign enemies and when unable to to so themselves, defend against domestic problems.

No it's not. Your missing the forrest for the trees here. Your constitution was a blueprint for control by a ruling class. Article 1 Section 2-8 laid a foundation of taxation and law making only held by a ruling class. After taxation, you had no rights under this system. Why would they need to give you representation in a forced system!! They need only give you the illusion of it. If they can take it all by force every right you think you have under the system is an illusion. You are a slave.

I live in the Peoples Republic of California. We are trying to fight for our rights here. My wife and I are debating on moving back to Oklahoma. I have jumped though the hoops here to get my Exposed and Concealed weapons permits. The restrictions on firearms ownership here is horrid. Soon Barack Obama will make the rest of the nation just as bad. "Fear the Government that Fears its people owning Firearms." that is a paraphrase of course.

the constitution also declares the president the 'commander and chief' of the armed forces. For a military officer to defy president is to defy the constitution. But if you want to cherry pick which parts of the Constitution you want to follow, that's up to you. The second amendment give the right to bare arms...which could include nuclear arms (since it doesn't specify). Would you up hold the right to bare (nuclear) arms? I talked with one guy today that said would (lol)

According to the Military Code of Conduct, allows a soldier not to obey the orders of a superior if the order is against the US Constitution, is immoral, or is against the MCC. Remember the oath is for enemies foreign and DOMESTIC. That would include the US President. The Founders did that to King George, and yes nuclear. The 2nd amendment was put there as the last/4th arm of check and balances.

BTW do you know what an amendment is? It a change that's been made to the constitution. For someone who is against any changes to the constitution you sure do accept the authority of changes to the constitution. A little hypocrisy anyone? the founding fathers envisioned a country where blacks were not equal were they wrong? that was then changed to 3/5ths equal. was that wrong? then they gave them full rights...was that wrong?

You wanna take away second amendment rights... you wanna take away the 10th amendment rights of the state..... you wanna increase government intrusion outside of the scope of the constitution....... What Constitutional violations are you talking about? Congress recently passed a law permitting loaded firearms on the grounds of public parks... in fact, it was stuck in a bill (by a Democrat) that was supposed to be about credit card reform. And Democrats have expressed complete apathy about gun control, despite a surge in recent shooting sprees.
Unless you can cite REAL examples of Constitutional violations, your kind of jingoistic demagoguery is nothing but inflammatory paranoia.

The Constitution doesn't ONLY protect individual rights... the Preamble and Article I also emphasize promoting the "general welfare."
Article 1 further allows the government to
- tax
- borrow money
- "coin" (print) money
- regulate the value of money
- regulate commerce
- pass all laws 'necessary and proper' to further any of the enumerated powers
The 5th Amendment allows the fed govt to seize property, and the 5th & 14th Amendments allow liberty & property to be deprived WITH due process.

To violate the 10th Amendment, you have to assert some exercise of federal power that has exceeded the scope of the Constitution. Where has the federal government exceeded its power?
The executive orders assign perfectly rational emergency protocols that have not, to my knowledge, ever been invoked or challenged. Given that the Constitution assigns the fed govt the primary responsibility of providing for the "common defense and general welfare," and lets it seize property, they are all fine.
