UPDATE: I am on appeal for this arson charge, the last document I recieved about this issue was from the Kansas Court of Appeals stating that my case has been assigned for review. As soon as this step is complete I will know if I get docketed for a future re-trial date.
I once had a fire in the kitchen of my apartment. It was the fault of my wife for leaving grease on the bottom of the pan. I was lucky and put the fire out quickly. Which I am thankful for as I did not have renter's insurance at the time. Now I got renter's insurance and can make the apartment complex wealthy if I burn the place down. But I really hate the apartment where I live so I am careful not to damage anything. Cause I do not want them to get and money.
Imposed Sentencing was on 28th January 2011, the Judge Burdette who never looked at the new evidence, denied N.O.V. and Arrest of Judgement motions. Instead I was forced to probation with the following terms which is violation of the rights of the accused and 4th amd. secure persons.1. Permit court/correction officers to tour your home. 2. Not to carry a weapon/firearm. 3. Submit DNA blood sample to lab and pay for testing. Failure to comply is a seperate charge of probation violation&prison.
I never spoke with anyone at the Sheriff's Department, but I did in fact tell the nurses when I was burned in Kansas City to inform them I had not had medical attention in over 24hrs. The first Breach of Privacy occurred when Chief Hockett acquired information relevant only to my care from the deputy at the Cherry County Hospital by eavesdropping. The second violation of my Rights to Privacy was by Mr. Hockett gathering personal information from a nurse without my permission or knowledge.
After 3 days in court ending 10 NOV 2010 the Jury found me guilty of criminal charges, ARSON/KSA 21-3718 -damaging any building which is a dwelling with intent to injure or defraud an insurer or lien holder. With that said, pay attention to that last part, defraud an insurer, cause thats the only thing which would apply in this case.Look @ Fraud by State Farm 2 of 2 ,warrant, do you think probable cause was evident?
There was no mention of my actions regarding insurance at all. NONE
Soooo, who is the person in the video with the BURNS? You?. Well even if you didn't claim monies, YOU BURNED THE HOUSE... Duhhhh - That is why you don't want to CLAIM any money. To drop the fraud charges... SEE YA! "Jail"
@jwgizmo1 Your missing the point completely. The initial charges stem from false testimony by the insurance agent Mike Haire. He paid money to my father, then testified that I had something to do with it, I can actually prove I wasn't even aware of the claim. The first check was sent to my dad while I was in the hospital.

When I showed up for the hearing, the Judge granted the withdrawal from my first paid lawyer and on 19 July, I ended up going to jail for 12 days, Finally I got a state appointed lawyer and my bond was re-instated. Ironically my new lawyer was in the office on the same day I was arrested. My next court date (trial) is set for 8 Nov 2010. I will be pleading not guilty to a jury and I will attempt no continuance under my own power.
Sad to hear your story, state farm is one of the top ten worse insurance companies, they will delay, deny and dispute if taking to court. they got the money to dispute in order to not pay a claim.
