I know that the laws on recording telephone calls vary from state to state. In Washington state, where the Discovery Institute is based and where I live Q-Dragon's activity would have been illegal. But that may not be the case in other states. Since this video is still up on this site that seems to indicate that it may be legal for Q-Dragon to record it where he lives. I remember this argument when the Monica Lewinski scandal occurred. Her recorded conversations were legal where done.
As old as this video is, I have to second some of the comments left here and state that it is my hope that you end up publishing a variety of Peer Reviewed papers someday.

Its an insult tho, let us record you or dont get your call thru :(
So when ever the ones that dont say record at all or "monitored" (Especially if its them calling me) I ask them if it being recorded, when they say it is I point out how thats a crime and ask to speak to the supervisor LOL
@gorilla199uncensored Quite wrong, actually. Canadian law requires only that at least one party to a telephone conversation, or a court order, be obtained to legally record the call. This means you can ALWAYS legally record your own calls.
@gorilla199uncensored How about the Criminal Code of Canada, Part VI (Invasion of Privacy), Section 183.1 Consent to Interception:
Where a private communication is originated by more than one person or is intended by the originator thereof to be received by more than one person, a consent to the interception thereof by any one of those persons is sufficient consent for the purposes of any provision of this Part.
@gorilla199uncensored Perhaps you should actually READ IT instead of desperately trying to find a way to weasel out of the applicable law.
Even if you discount the fact that ALL parties to a phone call are originators of the call, Q-Dragon cannot be pretended to NOT be an originator of a phone call that he PLACED. It also makes no mention of what party is given permission to intercept (which actually means record), only who is able to give it.
@gorilla199uncensored All right, so we know you don't care what the law says, and you don't care that the liar Luskin was entirely wrong when he pretended Q-Dragon might have broken it. At least now I know you're completely unwilling to deal with reality and I don't need to demonstrate that you're wrong any further, since you've declared a total disinterest in reality.
Luskin is low down, dispicable, cowardly piece of shit. I would absolutely love to smack him in his snarky little lie spewing mouth. Luskin is a cry baby, tattle telling, weak ass, little bitch! I hope DonExodus2 goes after him with everything he has got for this horseshit. Give me a break Luskin, and please...go fuck yourself!
The Action was not illegal. You DO not have to inform someone they are being recorded otherwise police would have to tell you that. Luskin is full of AIDS and fail.
Here in Tennessee it is only illegal to record a call if BOTH parties are unaware the phone call is being recorded. If one party is aware at least it is perfectly legal.
The all-party consent requirement can be satisfied if one party has announced to all other parties engaged in the communication or conversation, in any reasonably effective manner, that such communication or conversation is about to be recorded or transmitted.
I don't think that you would be punishable since you are located in Canada.
"Canadian law requires that at least one party in the phone call be aware of the recording."

I find it quite amusing how you ask him if his -company- filed false DMCAs and yet his answers are that -he- didn't file any.
Methinks the Luskin doth protest too much... Or maybe he's simply avoiding the question, knowing that an honest answer will show his company did file false DMCAs.
Especially since later he seems to explain that the Discovery Institute did in fact "send letters".
Nice to see another Canadian kicking ass, especially one half my age.
i feel you've missed an extremely rare opportunity here, you could have easily bring up the fact that he didn't give you a straight answer to your question, all he said was: "there's a lot of misinformation out there" and thus, he avoided answering your question.
not mentioning that you could have bring up countless times of him being dishonest and times which he lied.
at the end you even apologized to him even though it's not illegal to record a phone call between only 2 people...
They still have yet to answer for these false DCMA claims. If you god people are really so high and mighty, why not just come out with some kind of earth shattering truth to silence your nay-sayers--oh wait, I forgot.... *Crosses fingers*
I knew it wasn't illegal as soon as he said it--the guy got scared. He probably had someone standing behind him telling him to ask if it was being recorded because he has to ask and the guy cannot lie. That way they could act like a victim and hang up because they have lawyers telling them not to say too much to begin with, I'd imagine.
Federal Law has Jurisdiction when you cross state lines and there are certain amounts of the law suit required, and this is a crime, not just a civil case.
Wow he didn't think to ask if the phone call was being recorded until 3 minutes into the conversation, talk about brain dead. That would of been the first thing I thought to ask. Way to go qdragon that was an amazing call.

I think if you simply asked for an interview with Mr. Luskin regarding the situation, mentioned your subscriber number he might of given you a full interview you could've recorded. Too bad.
Mr. Luskin seems to really love that non-sequiter fallacy. Of course, someone who so proudly claims to have graduate-level education in law really should have some knowledge of formal logic. Even if the claim was made under other pretenses, it would have taken less time to explain them to repeatedly comment on the quantity of misinformation in circulation, it also could've been a chance to refute it if he chose to instead of bullshitting at an eighth-grade level.
I think you should be fine, because you did answer honestly that the phone call was recorded and I don't think you have to tell the other party that you're recording. Of course, I'm sure you double checked this with your legal advisor.
one party to the conversation must know it is being taped. You can not tape a conversation where neither party is aware of the taping. I hope this ends the debate. This lid did nothing wrong because he was a party with knowledge
Its actually not illlegal I believe. The only law against such an action is using unauthorized video/audio footage of someone and use it as evidence in a trial.
But to record someone otherwise is not an illegal act
I know that the laws on recording telephone calls vary from state to state. In Washington state, where the Discovery Institute is based and where I live Q-Dragon's activity would have been illegal. Was it? I dont think so!
"or is intended by the originator thereof to be received by more than one person "
No it was a phone call to one person.
(Im cool I can count to 1)
So it doesnt apply, and its talking about giving consent to another person to record it.

Come on guys, it's worse than illegal to record phone calls, according to the bible it's a sin. Look up the Book of Telephone 4:24

Other than that, YOU WIN TEH INTERNETS!

one party to the conversation must know it is being taped.
