If it has a comma it says what i think it does, If no coma than you are right. it separates the thoughts. an elc. motor is a motor piston or not, statute puts a cap on the size of piston but not a minimum,doesnt say 1-50cc.

@RP4409 Yea...CC is a measurement of volume (Cubic Centimetres). It's basically the volume displaced by the piston. Electric motors do not have CC ratings (because electric engines have motors not pistons). I would assume electric motors are rated in Watts. Do they say you need and MOT (or whatever your equivalent Vehicle Inspection for Fitness Certificate is)...what about turning indicator lights? So while it's not common to measure a combustion engine in watts here in the US, I believe elsewhere in the world engine output is measured in watts. Also, a motor includes the internal combustion engine so your argument is irrelevant.
CC's are Cubic Centimeters. It refers to the size of the chamber in piston-driven motors. There is no volume to measure in an electric motor. Electric motors are usually classified by wattage. -Electrical Engineer

I had my car keys with me and my union carpenter papers when the cops kept hounding me about "why do I have car keys?" due to having no license at the time. I sarcastically told them "why do you think I am on a bicycle?"

Under arizona state law if any form of transportation has a motor in it it is considered a vehicle. It goes the same for dirt bikes and scooters. Bikes are considered a form of transportion and you can be cited for not following laws just like a vehicle. Also if you video tape any police officer they always call for back up for legal reasons. Also there is a way to register a bike with a motor in it as under a scooter or a dirt bike. You can registered your bike and I have seen it done.

if you took everything out of a SUV including the engine you wouldn't fall under the vehicle law because you are using man power to power it and you could but in pedal heavy duty ones and but in gears to make it move. its possible to do but going up a hill man that would hurt a lot but still you can do that and still own a car and you would need a driver license it would be a motor vehicle.

Google images of electric bikes. Do those look anything like it could carry you anywhere near the distance a car could? True, it's capable to running without you pedalling, but for the most part, it's just to increase the rider's endurance.

And an engine, can also include electric motors. some of the mountain bikes have large electric motors on them.....only allowed off road with a high watt motor.....a state law.......maybe you were going faster than allowed for a motorized bike as is a moped over 50cc......you must have a license if over 50 cc because they can go 40 to 50 mph.....so if you were going the limit ,no reason except for calling them idiots on the video while the cop is standing in front of you in earshot!

See the reason I know these things is because I one an sleuths bike that is made like a regular scooter, and yes, I've been pulled over by the cops. In fact, I had teach the cops about the new law because they didn't even know about it.

I see you all saying "oh it doesn't use pistons so it doesn't count" okay, but putting the law aside for a second; in my opinion a bike that runs on any type of motor (electric,piston, or anything otherwise) is considered a vehicle.
I watched the video, and it looks like the cops are just confused because they don't know what to make of an electric bike because there isn't a law about how to handle electric bike.

In order for a motor to have CC's it must contain a "PISTON". If it contains a piston and is under 50cc's its a called a moped by statute. If over 50cc's it's labeled a motorcycle and needs to be registered.
The statute says a [Helper motor "WITH" a maximum piston dis of 50cc's] Please focus on the word "WITH"

@RP4409 I focused on the word "with" when i watched it and it turns out it is actually "IF". I have a feeling that the statute is written like this. "moped means a bycycle that is equiped with a helper motor, if the vehicle has a maximum piston displacement of 50cc or less." If it has a comma it says what i think it does, If no coma than you are right. it separates the thoughts. an elc. motor is a motor piston or not, statute puts a cap on the size of piston but not a minimum,doesnt say 1-50cc.

@RP4409 Yea...CC is a measurement of volume (Cubic Centimetres). It's basically the volume displaced by the piston. Electric motors do not have CC ratings (because electric engines have motors not pistons). I would assume electric motors are rated in Watts. Do they say you need and MOT (or whatever your equivalent Vehicle Inspection for Fitness Certificate is)...what about turning indicator lights? Police should chase criminals, not a man on a bike going to church.

@minibikerider1 A watt is simply a measure of power output. And, it's the basis of horsepower. 1 horsepower = 745.699872 watts. So while it's not common to measure a combustion engine in watts here in the US, I believe elsewhere in the world engine output is measured in watts. Also, a motor includes the internal combustion engine so your argument is irrelevant.

CC's are Cubic Centimeters. It refers to the size of the chamber in piston-driven motors. There is no volume to measure in an electric motor. Electric motors are usually classified by wattage. -Electrical Engineer

Electric is not categorize in CC or cubic centimeters refers to engine capacity but in WATTS of a ELECTRIC MOTOR not GAS ENGINE which would be categorize as CC of engine block. @mindfuckerification You can not CC a Electric Motor, because it is rated at Watts not CC (it also wrote in a legal form). Remember CC even with no piston, has to be a ENGINE BLOCK (CC) not a ELECTRIC MOTOR (watts). To let you know how I know this is because I myself drove less then 1000 watts motor scooter that is legal to drive with no license or insurance because it rate less then 1000 watts, but if I have drove a 33.9 cc Engine block that is less then the CC then it is legal too.

I had the same problem except I was riding a high end mountain bike. I was pulled over by 5 police cars and the first thing out of the cops mouth was "where did you steal the bike son?" I had my car keys with me and my union carpenter papers when the cops kept hounding me about "why do I have car keys?" due to having no license at the time. I sarcastically told them "why do you think I am on a bicycle?"

@mindfuckerification - I have to agree with you on this and the pedals are used for starting that helper motor which is why it is so hard to pedal and is an old concept on the very old single cylinder scooter bikes. we had one in the 60's... we can ride electric and gas scooters/bikes inTexas UNDER 50CC.

Too many back yard attorneys on here. Whether you like the guy or not the law is what it is and isn't what it isn't. There is no middle ground.
If the letter of the law applies it applies, if it doesn't it doesn't.
Obviously the cops didn't like being filmed and thought the guy was an asshole, so they wrote him a bunch of fines. The cars were meant to intimidate him and it backfired.
However they didn't write the tickets up correctly. Period. That's the end of it.

With the resurgence of electric vehicles (they're 100+ years old), that thing IS classed as a moped because it's PRIMARY method of movement is a MOTOR whether it has pistons or not, the pedals are SECONDARY, just like a gas powered moped.
As far as the no windshield thing goes, there's THOUSANDS of motorcycles out there without them, so it's BS to give a "naked bike" a ticket.

@RP4409 Those same regulations work for cars, and Electric Cars MUST be registered, licensed, and plated, and tagged before you're legal to drive them on the streets.
Just because the wording of the legislation hasn't caught up yet doesn't mean jack, the fact remains that particular MOPED is electric powered FIRST, and human powered second.
To be considered a true electric bicycle, it would need to be a bicycle first, with an electric motor attached later as a design afterthought.

Under arizona state law if any form of transportation has a motor in it it is considered a vehicle. It goes the same for dirt bikes and scooters. Bikes are considered a form of transportion and you can be cited for not following laws just like a vehicle. Also if you video tape any police officer they always call for back up for legal reasons. Also there is a way to register a bike with a motor in it as under a scooter or a dirt bike. You can registered your bike and I have seen it done.

A VEHICLE according to Blacks Law Dictionary is "Something used as an instrument of conveyance. 2. Any conveyance used in transporting passengers or things by land, water, or air. Balcks Law Dictionary (8th ed. 2004) , Page 4822. Passenger and Vehicle are terms of Commerce. If you are paying a taxi for transport, you are a passenger in a vehicle. In a car, you are the drivers guest, etc

I have also read that most cops today around the country can NOT have an IQ of over 100 or else they will not hire them...and crap like that with him looking for the gas tank and muffler IS part of the reason why. The others are so that they can deceive the cops in regards to the Constitution and Maritime law which is what's REALLY governing and controlling the country. It was a vehicle while the motor was used to move the bike but it's not a moped. So on that point, all the tickets should be thrown out on that point.

@Claybreaker2 Wrong half of the cops out there do harass American taxpayers. Prime example i was 17 hanging out with a friend when i got pulled over by two County Sheriffs for having a tail light out, which i checked when they left and it was all working. Then when they found out who my older brother was i was pulled out of the car and harassed for 15 minuets and treated to be taken to jail, I have no priers and i pay taxes. Going to Law makers wont salve that issue.

if you took everything out of a SUV including the engine you wouldn't fall under the vehicle law because you are using man power to power it and you could but in pedal heavy duty ones and but in gears to make it move. its possible to do but going up a hill man that would hurt a lot but still you can do that and still own a car and you would need a driver license it would be a motor vehicle.

Just because it has pedals, that doesn't mean it's not a vehicle....if i cut out the floor boards of my car like a flintstone mobile so that it's possible to push it by feet, does that make it not a vehicle???

@thetravsaysthis Electric bikes aren't really meant to be used like cars. The electric motor is just to help the rider endure long distances, such as across town or to work from home. Google images of electric bikes. Do those look anything like it could carry you anywhere near the distance a car could? True, it's capable to running without you pedalling, but for the most part, it's just to increase the rider's endurance.

@alex9966 The problem is that LEOs (mainly city cops) not only don't know the fed law, they don't WANT to know &'ll get pissed if you know it & they don't. They'll also start making things up to hassle you about it.
The saying "ignorance of the law is no excuse" can work both ways. & I've made that known loud & clear to quite a few cops who tried making up BS to hassle E-bikers.

there are peddle bikes that can easly go over 20mph with no problems if they have on a helmet they cant do shit other then a speeding ticket. ANd yes i was pulled over by a cop and he was going to give me a ticket and i said this is a bike how can i speed you know a judge will through this out of court. he ripped up the ticket and walked away. I work with them on a regular basis and they do have a few problems I keep telling them use your brains first and make shure you know the law first!!!!
