  • There is only one state where it is explicitly illegal to record your interactions with cops, Illinois, and that has exceptions. That law is also being challenged and I can't see it standing up to Consitutional scrutiny. Look up the Glik decsion that came out late last year. Its language evisorates any interpretation of laws that restrict recording police encounters and makes a clear case as to why Constitutionally such laws can't work. Only officer safety has any real effect but not much.

  • People mix this law up with wiretapping which is TOTALLY different. Wiretapping is when a third party listens into a conversation between two others. This has nothing to do with it and people can record in public whoever they want without permission.

  • @paintballingguy Never really seen any two way radios in any hotels I've been to, except the Hilton. Though, I think most of the places I've been to are more of...motels. When we went to the hilton, though, they had a gift basket with all sorts of food, so I took that as an open offer for just about anything that wasn't too big for me to steal without getting suspicion. There were a lot of guards there, sadly.

  • I have a question someone might be able to answer. Does a search warrant state what the cops are looking for? So my question is, if they are looking for hotel towels, how can they confiscate guns? Seems strange that cops can get a warrant for willy nilly crap like towels and use that as an excuse to search the home and end up confiscating guns that have nothing to do with the cops investigation? What's to stop them from confiscating TV's and/or jewelry?

    a warretn does state what the cop is looking for but it has to be in a place were it could likely be hidden. for example, if the cop is looking for a shotgun, they cant look in a shoebox. a shot wouldnt ever be in a place like that. a warretn also state rooms and other locations that they are looking. they can only look in those locations. BUT if something is in plain sight, they can confiscate it if it is incriminating.

  • @madjimms depending on what the investigation is, you have to show them when they request it. If they suspect you are underage, involved in a crime, or just wants to run ids to make sure no one in this suspicious situation has a record, he or she can. As long as they give you a reason for why they are running your license, and that reason is credible, then you have to go with it.

  • @madjimms there is no (US LAW) they base it on state law, in my state if they have a case they are investigating, or are suspicious, they have every right to ask, they just have to give you a valid reason, which you can check with the dept. I dont need to check flex your rights, this is a policy i know and practice well. :)

    But since you don't pay attention to what's going on in the courts, you spout dis-info whether you meant to or not. It has always been legal. The woretapping laws are bullshit when used to record police. If you READ the wiretapping statutes you'd see that they only apply to SECRET INTERCEPTIONS.

  • @junfaa sorry i didn't mean to be so aggressive but we're getting jacked up nationwide because people don't really know what's going on! So i spend an hour or so a day posting and trying to wake people up to where the remedy is. It's in the law. It's all there, but you have to READ it. Google makes it easy all states have .gov sites where they post the laws and statutes. I get so frustrated and didn't mean to take it out on you!

It means that rules regarding recording police are null and void ab initio (from the start) and you are under no legal obligation to follow any such "rule" nor is any agent bound to enforce it (supreme court on unconstitutional statutes, which is a common SC subject, so it's a commmon problem in that legislatures tend to legislate unconstitutional laws.)

  • What possible justification can these public servants cite as a reason why you should not be able to record them? I mean I just dont understand. They are an employee of the people who work in the public arena for the public allegedly for the better good of the public and I would think recording their performance in the exercise of their duties would be encouraged as a measure to ensure that they are consistently performing to the highest of standards. How else can you be sure that they are?

  • The search should be video recorded... to protect the police and the persons being searched from any allegations of wrong doing.

    That being said... if you enter my residence I should have every right to record you to ensure that no property was seized that did not pertain to the warrant and that the conduct of the residents and officers was civil.

    This "wire tapping" bullshit has to stop. If your in the employ of the public your actions should be recordable to prevent abuse

  • To the police who are watching this video: most of you belong in prison for the crimes you have committed, because the power you have demands higher standards of conduct, not lesser. Those higher standards are there to protect you from the inevitable backlash were your crimes continually swept under the rug or under-charged. Unfortunately, because the reality exists that you are held to a far lesser standard of obedience and punishment, you are quickly losing all credibility, all respect.
