I was forced to beat the shit out of one of these sign carrying fundies a few weeks ago. I asked them nicely to turn their signs around until i passed with my kids, they refused, so i told them i would be back soon. When i returned, minus kids, two of the fundies ran away leaving their compadre to his fate.....I havn`t seen any fundies, or signs since.

To obtain a permit, you need tol go to the courthouse of whatever city you are in and fill out all the necessary paperwork pertaining to the purpose and the length that the signs would be up. Afterwards, it is at the sole discretion of the courthouse to decide whether or not you or your organization is worthy of such a permit. :-)

That's not true; it is unconstitutional to have any law requiring a permit for small group protests on public sidewalks; provided they do not obstruct the flow of traffic. If you know of a specific town or city with such a law, please let me know what city and specificaly what ordinance so I can have a lawyer contact them!
in my town any assembly gathered to protest, must reg./inform the town in advance of that protest. mabey i am reading this wrong but again, i dont see the problem with reg. most protest do and there are little to no problems. most are well versed in the process and know how to get their point across the legal way. i think this individual was just looking for some shock value and publicity.

While there is the First Amendment, you still need a permit to exercise your first Amendment in public regarding sign displays and to peaceably assemble as well. The officer's violated the Pro-life activists rights. As a pro-life counselor we do NOT hold up graphic signs but choose to work to show compassion for women & get them resources to get help. Women do NOT want to have abortions. They feel they are forced to because of pressure from society, men, or peers. Fear of judgment or financial burden are some reasons they have abortions. The end result is Post Abortive Syndrome, infertility, or even death. Abortion is devastating and hurts women.

police and military do not have 1st ammendment rights while they are on duty. DoD Directive 1325.6, for example, says it's DoD policy to preserve military members "right of expression ... to the maximum extent possible, consistent with good order and discipline and the national security" if not misconstrued as speaking for military (off base, off duty, & out of uniform). Other directives preserve rights to protest, etc.
Regardless, military restrictions on certain civil liberties are implimented by laws, passed by Congress, in a manner consistent with the Constitution. There are no similar laws, passed by Congress, limiting a police officer's Constitutional freedoms.
That is why they are called G.I.'s i.e. government issue and are the property of the government without the rights afforded civlians through the bill of rights. You're out of date, xsgtusmc. The military has made great strides in recent years to reduce restrictions on the civil rights of military personnel. As such, military members now retain many of the rights described in the Bill of Rights, with restrictions only in certain situations or venues (combat, for example). As just one example, DoD Directive 1325.6 addresses free speech, association, protest, petitions, and so on. Other directives address related issues, such as religion (1300.17).
Finally, xsgtusmc, since I have considerable experience (35-years enlisted, officer, and now civilian analyst), it would be fun to continue discussions about the military. However, none of that relates to the issue at hand - police officers.
Those officers are civilians just like you and I, with few laws abridging their rights to free speech. Instead, their behavior is tempered by departmental employment policies, with those policies tempered by the free speech clause of the Constitution.

The restricting phrase "to the maximun extent" is in itself restrictive not "free". ART 22 you cut and pasted, gives no explanation of the meaning. in the military it is known as the catch all article hence the phrase "catch 22" it means you can be charged with any violation not specifically covered in the UCMJ. It is well known in the military. It is also well known that we in the military did not have the rights of civilians hence a UCMJ. Off base and out of uniform makes no difference.
As stated, xsgtusmc, Article 22 of UCMJ defines "Who May Convene General Courts-Martial" (the President, Sec of Defense, etc.) with not one word about free speech or restrictions thereof. It's not a "catch all" article.

The only way these cops can avoid damages is to claim qualified immunity, but in this case the right was clearly established and the issue of "permits" has long been settled. The courts have held that to challenge free speech you use free speech, not suppress it. FILE A LAWSUIT THEN FILE A CRIMINAL COMPLAINT WITH THE US ATTORNEY AND THE FBI. I was forced to beat the shit out of one of these sign carrying fundies a few weeks ago. I asked them nicely to turn their signs around until i passed with my kids, they refused, so i told them i would be back soon. When i returned, minus kids, two of the fundies ran away leaving their compadre to his fate.....I havn`t seen any fundies, or signs since.

To obtain a permit, you need tol go to the courthouse of whatever city you are in and fill out all the necessary paperwork pertaining to the purpose and the length that the signs would be up. Afterwards, it is at the sole discretion of the courthouse to decide whether or not you or your organization is worthy of such a permit. :-)

That's not true; it is unconstitutional to have any law requiring a permit for small group protests on public sidewalks; provided they do not obstruct the flow of traffic. If you know of a specific town or city with such a law, please let me know what city and specificaly what ordinance so I can have a lawyer contact them!

While there is the First Amendment, you still need a permit to exercise your first Amendment in public regarding sign displays and to peaceably assemble as well. You are NOT allowed to display signs in public without a permit! Ok? I know Mr. Marcavage, people learn sonething new everyday. You needed a permit to display those signs. The officer's violated the Pro-life activists rights. As a pro-life counselor we do NOT hold up graphic signs but choose to work to show compassion for women & get them resources to get help. Women do NOT want to have abortions. They feel they are forced to because of pressure from society, men, or peers. Fear of judgment or financial burden are some reasons they have abortions. When the government begins to break the law and trample on the rights of people they are no longer enforcers of the law but have become tyrants. Tyranny unopposed will lead to your eventual enslavement. To not oppose tyranny is to walk in agreement with it and empower it over you. These fat cops probably have girlfriends that have had abortions so their wives don't find out. It bothers THEIR conscience so they use the power of the govt. unlawfully to sooth their own guilt.

police and military do not have 1st ammendment rights while they are on duty. They are there not to exercise their rights but to protect ours. they are supposed to be our servants not the other way around. stewart5x thinks that officers can say whatever they want while at the same time speaking on behalf of the people (government) they serve. a private citizen has free speech but as an officer they should be held to a higher standard. if they can't hold it neither should they be cops.

WHy because they are to defend it not practice it. they are to protect those who practice and exercise it not oppress those who do. UCMJ Art. 22 discusses "Who May Convene General Courts-Martial," xsgtusmc. UCMJ says little about free speech, leaving subject to directives instead.
DoD Directive 1325.6, for example, says it's DoD policy to preserve military members "right of expression ... to the maximum extent possible, consistent with good order and discipline and the national security" if not misconstrued as speaking for military (off base, off duty, & out of uniform). Other directives preserve rights to protest, etc.

Regardless, military restrictions on certain civil liberties are implimented by laws, passed by Congress, in a manner consistent with the Constitution. There are no similar laws, passed by Congress, limiting a police officer's Constitutional freedoms.

You're out of date, xsgtusmc. The military has made great strides in recent years to reduce restrictions on the civil rights of military personnel. As such, military members now retain many of the rights described in the Bill of Rights, with restrictions only in certain situations or venues (combat, for example). As just one example, DoD Directive 1325.6 addresses free speech, association, protest, petitions, and so on. Other directives address related issues, such as religion (1300.17).

Finally, xsgtusmc, since I have considerable experience (35-years enlisted, officer, and now civilian analyst), it would be fun to continue discussions about the military. However, none of that relates to the issue at hand - police officers.
Those officers are civilians just like you and I, with few laws abridging their rights to free speech. Instead, their behavior is tempered by departmental employment policies, with those policies tempered by the free speech clause of the Constitution.

Anyway, I'm aware of one thing - you're blaming the wrong people. Police don't control the militarization you describe, nor do soldiers control how they're used. Officer use the uniforms & guns issued to them while the military follows orders.
Thus, if you have a complaint, you need to focus on the elected officials (Dems & Repubs equally) who do control these things. They started it and the only ones who can end it.

The restricting phrase "to the maximun extent" is in itself restrictive not "free". ART 22 you cut and pasted, gives no explanation of the meaning. in the military it is known as the catch all article hence the phrase "catch 22" it means you can be charged with any violation not specifically covered in the UCMJ. It is well known in the military. It is also well known that we in the military did not have the rights of civilians hence a UCMJ. Off base and out of uniform makes no difference.

As stated, xsgtusmc, Article 22 of UCMJ defines "Who May Convene General Courts-Martial" (the President, Sec of Defense, etc.) with not one word about free speech or restrictions thereof. It's not a "catch all" article.
And the phrase "Catch-22" originated from a 1961 Joseph Heller novel referring to a bureaucratic "no-win situation," in this case a made-up military rule with contradictory circular logic preventing one from avoiding combat missions.

Hey man, I have to agree with you. However, as someone who is from Media, who grew up there, and left for reasons similar to this, I have to say that you won't win. Media is a great town, but the cops suck. Extremely unprofessional. In fact, my whole family, and I come from a family of 6 kids, we all left because of reasons like this. The first amendment doesn't apply to you in Media. Those cops can walk right into your house without a permit if they feel like it. That's Media for you.

You have 1 year from the time of this deprivation of the 1st Amendment right to file a federal civil action. The only way these cops can avoid damages is to claim qualified immunity, but in this case the right was clearly established and the issue of "permits" has long been settled. The courts have held that to challenge free speech you use free speech, not suppress it. FILE A LAWSUIT THEN FILE A CRIMINAL COMPLAINT WITH THE US ATTORNEY AND THE FBI. THEY ARE REQUIRED TO INVESTIGATE.

If you believe that people should all be accosted with graphic signs depicting the gruesome images that come from their actions, that means I can place large signs with pictures of pigs being slaughtered and baby chicks being ground alive in meat grinders by my neighbors houses and they should have to leave them there.
