If they would just listen to the guy having (repeatedly) stated that he had been drinking, it would negate the need to undergo the test. What then has to be proven is whether he was in fact driving. Instead, they kept provoking him which in turn made he seem aggressive. Clearly, the officers were following procedure but did so without the use of common sense.
