If I'm not mistaken this is from South of Delia, which is ALL cover songs. Stating that it's from his "new" album would imply that it's a cover. Check out his cover of Acadian Driftwood. It's wonderful.
I wouldn't worry about Richard crediting Jeffrey. They are friends. Besides, its usually other artists covering Shindell, so I am sure Jeffrey is honored.

He gave credit in the album literature as required. You are not required to give credit when you cover a song live.

Are you kidding? I just listened to Jeffrey Foucault perform this song and there's hardly a difference, except RS's guitar part is better.
