Habeas Corpus only solves half the problem. No real defense can ever be given unless you also have the right to face your accuser or to have evidence of an individual or individual victims. No victim = no crime. Until there is an individual victim or evidence leading to an individual victim you can never put up a defense. If an individual kills a group of people then that person gets judged on each individual count of murder. Why should the case be different in any other situation?
