Oh, and in response to this video, the reason even non-conservatives are put off by the "policy" part is specifically because the first word that came in to her mind to describe what the court of appeals does was "policy", and not "precedent". If she had thought of herself as "Setting Precedent" instead of seeing herself as "Making Policy" then there wouldn't be an issue.

She did not deny them the raise, she simply voted for the test to be re-written following guidelines that were NOT followed when the first was written.
Also read up on the New Haven's extensive and prevalent problems with discrimination in its history.

Oh, and in response to this video, the reason even non-conservatives are put off by the "policy" part is specifically because the first word that came in to her mind to describe what the court of appeals does was "policy", and not "precedent". If she had thought of herself as "Setting Precedent" instead of seeing herself as "Making Policy" then there wouldn't be an issue.
There is a real difference in thought that she betrayed. She has a very bad paradigm for a Supreme Court Justice.

There was no dissenting vote on the panel. The panel made a summary order to confirm the lower court's ruling without analysis of their own. WHAT THE HELL ARE WE PAYING THEM FOR?
Judge Jose Cabranes, a Clinton appointee, protested the ruling and lack of analysis by the panel and forced a vote on re-hearing the case. Sotomayor voted with the slim majority 7-6 to NOT rehear the case; however, the case is now being reviewed by the Supreme Court.
