  • The founding fathers never concieved of people operating 3 tons of steel at a mile as minute through populated area. Your precious 4th amendment rights have nothing to do with checking on people late at night who are usually drunk and a danger to the general public. Don't want to be checked? Don't operate a motor vehicle queer.

  • 1) The Founding Fathers were inventors (read: Ben Franklin) and I'm pretty sure they had wagons with wheels on them that were on packed streets with animals, children, etc.

  • I don't know why you're affiliating the 4th amendment with a sobriety checkpoint. It's a stop and go procedure. They ask you if you've been drinking and if your answer is no, you're on your way. They don't search or seize anything unless of course you're idiotic enough to drive intoxicated. You have the 4th amendment scrolling at the beginning but it seems you didn't even read it. If you're pulled over by a cop for violating a traffic law, you have to stop so in essence, it's the same thing.

  • i hate to break this to you,,,but I was charged with a DUI for prozac being in my system,,and thr bottlle was in my puse and said i could drive on it,,,i blew a 00,,,i had been sitting still and was hit by a speeding car going about 40mph in a 25mph school zone,,,i was knocked out cold,,,,when i woke up i was dragged out of my car and screamed at by police forced to take a sobriety test when i couldnt stand up straight,,,i had a gash on my forehead.

  • Not that it really matters at this point, as we ignored the Bible & Constitution and rationalized us giving up our rights and adherence to the Constitution, and now we are going to pay dearly for it, just as the founding fathers warned.

    Google "PDD 51", "r210_35", or "H.R. 645" These checkpoints were simply to get us conditioned, and IT HAS WORKED OUT QUITE WELL.

  • This is a blatant violation of the the 4th Amendment, and what's worse is that they're now doing *FORCED* blood withdraws. I went to the Austin City Council Forum the other week where the Police Chief even talked about how they have a chair with restraints for strapping people down for their blood to be extracted. To top that, you have military now running these checkpoints, and as my videos show, this is comprised of citizens just like East Germany.

    So yes, this is a VIOLATION of the 4th.

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon PROBABLE CAUSE, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    So once again, where is the probable cause? Just because the Supreme Court says we're guilty until proven innocent doesn't mean that it's legal.

  • Probable cause is not needed for discretionless DUI checkpoints. The U.S. Supreme Court has ruled that the minimal intrusion caused by such checkpoints is counterbalanced by society's need to catch drunk drivers.

    You and I can certainly regard that DECISION as weakening the Fourth Amendment, but the fact remains that under our law the ultimate interpreter of the Constitution is the Supreme Court.

    So for now, such discretionless DUI checkpoints are not violating the Fourth Amendment.

    Whiteville, Tennessee Police, Military, & Homeland Security holding "safety belt inspection" checkpoints which is not only a violation of the 4th Amendment, but is also a violation of the Posse Comitatus Act.

    All of us are being acclimated for Martial Law, plain and simple. If these checkpoints were legal, then they would have done them in the late 1700s and onward.

    Discretionless DUI checkpoints are generally legal, per Michigan v. Sitz.

  • Just so you know, DUI checkpoints, immigration checkpoints, fish and game checkpoints, among others, have all been deemed LEGAL by the Supreme Court. So you may want to change the description where it says these checkpoints violate the 4th amendment, because they DONT.

  • Disagree w/Mr. Jenkins, when my husband witnessed BP agents allowing illegals to cross the border in Sonora,TX while they stopped him randomly - 10feet away the illegals were getting into cabs! YES! They were bringing them to the SS or welfare office to get money so they could get on the books, pay the driver and then have him take them to the driver's license bureau to get a license, no questions asked.

  • I had a similar experience when I went to South Padre a few years back... As we were heading down there, a hollowed out Ma' Bell utility truck pulled over *RIGHT ACROSS THE HIGHWAY* from the hardened border patrol checkpoint that was oozing with agents and we counted ~15 illegals that jumped out. Were the agents concerned? Nope.

    When/if I can find what little video I have (I tried getting it on film while driving 70 someodd mph) I'll throw it on here.

  • Checkpoints need to be set up to deport illegals. This is not a normal situation. There are 20 million people in this country illegally who's loyalty is to Mexico. We need them deported. Drunk driving checkpoints aren't good, but checkpoints for illegals are necessary to protect our country.

  • I was smashed into by a drunken driver while parked at a red light and my friend sustained injuries, and my vehicle was totaled. To top that, a few years before that; friends and I came upon a horrible wreck in which case the drunken driver killed two people.

    Based upon my personal experiences, I would still *NEVER* compromise my RIGHTS.

    They didn't have to envision DWI/DUI wrekcs as there always have been, and always will be, threats that people are willing to compromise their rights for.

  • the problem is we are so soft on drunk drivers so that there is no fear to drive drunk, its acceptable by most even in congress (ted kennedy) but in typical fashion in this country, we are bi-polar, we want to drink and have fun but don't want the responsibilty that tags with it, so we dream up these "check points" to catch drunks. it's honorable but illegal as hell. most pilitiacians turn a blind eye to this stuff for they don't know what else to do about the drinking problems in their state.

  • Don't be fooled. Statistics prove Roadblocks do nothing to address drunk driving but it DOES address revenue. In other words, These stops are designed to steal money out of your pocket. They pull you over knowing that 99% of drivers are not going to be drinking BUT this gives them an excuse to check your license, registration and insurance and look for any other violations which they can cite (steal your money)you with. It's purely revenue based an it's a violation of your rights.

To even suggest that one day our government would forcibly stop and make law abiding citizens answer questions would have been unthinkable a decade or two ago and is a slap in the face to those persons how died while fighting for our independence from England.   • elsamuraiguapo, You are almost right. In United States v. Michigan 496 US 444, the Supreme Court ruled that sobriety checkpoints COULD BE set up to be constitutional. One essential factor is that officers must not be allowed to use their discretion in deciding which vehicles to pull over for a sobriety screening.

  • What the courts ruled is irrelevant. Most laws are in violation of the constitution. Requiring a driver's license, insurance, inspections registration, Property tax, Income Tax. Permits to build, repair your own property. Permission from the state to paint your house and than having to pay a permit fee to do so. You can't cut a tree down on your own property without permission and a permit. Forced vaccines, Forced state schooling. It's ALL completely illegal under the constitution.

    It doesn't just stop there though with my drunk driver encounters, my friends and I came upon a terrible car wreck where 2 people were killed by a drunken driver. My friend and I found the guy, and I found his girlfriend.

    I DESPISE DRUNKEN DRIVERS. But guess what?
