Gramsci, Boethius and even(although only very loosely an intellectual) Hitler used time in jail to write and define their philosophies.

The majority of the people held in prisons - are not there for toying around with Judge Burke. Lest us not forget - there are many a victim out there of heinous acts - and the people that made them victims gave up any rights they were born into when said crime committed.
I agree with the first part of your sentance, but not the second. It may be the only way to deal with some criminals is to take away their rights, but you should never feel 'in the right' in doing so, afterall the nazis took away the jews rights and they fealt 'in the right' about it.
