  • This case is pretty ironic, two of the scariest cities of cyclist are NY, NY and philly. One (in philly) even hit a woman and killed her, people who are astonished by this case might lose their lives if not looking out over here on the East coast. They're worse than the drivers!

  • I can understand where the Plaintiff is coming from. We always hear about how the parents are responsible for the damage their kids do. I don't think this man was being malicious, just going on what he understood to be true. He has a severely damaged bike, a kid that was responsible for the accident, and a parent that won't pay. I'd be as mad as the Plaintiff.

    Parents are responsible for the behaviour of their children if their children acts maliciously or negligently ... not a silly mistake where both parties are at fault.

  • If the moron Plantiff wants to treat this BICYCLE accident like a car accident, then fine. His daughter REAR ENDED the Defendant's son. Therefore, she is at fault. Note: I don't actually believe it was anyone's fault, It was an ACCIDENT. The Plantiff just needs to STFU and pay for his own bike.

  • I didn't understand how JJ was accusing the P of being negligent. You signal the person behind you, not in front of you. The D's kid was negligent because he didn't signal. to the P's behind him and just randomly swerved into the P.

    But then JJ explained the 3yr old example; that kids that young can't be held financially responsible for these types of accidents because... well... they're kids! They're going to forget rules and cause accidents. It's up the grown ups to watch out for them.

  • So you take the girl on a 35 mile training run, and buy her a 3000 dollar bicycle. You're obviously serious about cycling.

    Cycling is one of the most accident-prone sports out there. Better get used to being bruised, and expensively having to repair/replace the equipment. That's kind of a built in thing with cycling.

    I love cycling, so don't get me wrong, but blaming others for accidents is just dumb. Accidents will happen, no matter what.

  • To all those saying she made a wrong decision, I disagree. Clearly people are clogging up the courts with ridiculous claims. This is just a stupid claim. It sends a message not to waste her time.

  • @nicolebmoviesFTW2 Judy is usually pretty spot on but I agree with you, she's not getting it right in this one. The plaintiff is probably lying in some aspects but still, if that little boy had thrown a rock through someone's window his mom would have to pay. So by cutting in front of the girl as she's passing he caused the problem.

  • @TheCurmudgen Exactly. Judge Judy almost never gets car-/bike-related cases right. I think she had a bad experience with an accident once, or one of her kids or grandchildren did, or something. She has to be thinking stupidly like this for a reason.

  • @TheCurmudgen 'throwing a rock' is an intentional action, not an accident...i think that is the point she was trying to make...w.r.t the 3 yr old who gets run over, I agree it wouldnt be the person's fault COMPLETELY, but he is still responsible to an extent IF he was going too fast...

    but these kind of cases are confusing for those of us who are unaware of the local laws...
