  • @bnetx1: I've been placed in the front seat of a Texas DPS car a couple of times. One time, he questioned me, then left me in his car while he questioned my wife in our truck to see if our stories matched. I guess he left me there because he knew of me and the fact that I've lived here some 30 years.

    So, it's not unknown.

    Interesting note was that my wife listened to our conversation on the scanner so knew what answers I gave before he asked her the same questions. Go figure.

You know the expression "pearls before swine?" I just say, "I invoke my right to remain silent" and wait for them to go away. I don't think it's ever a good idea to talk to the police.

FYI from inside the police are you are no longer in a "public space" and filming could be not legal ... you can film from outside the car in or inside to the out as long as the car is in a public place but not from inside the car filming the inside of the car.   • This officer was clearly quite misguided and misinformed, but I think he had good intentions, correction, I don't think he had bad intentions. This is more of a problem with training and lack of knowledge. With that said, ignorance is no excuse. It is actually pretty good to hear that the officer actually listened to you instead of just yelling and telling you to be quiet.

Of course they can find a few examples here and there, but it is the same fallacy that blacks find when they claim "police brutality". They take a few extreme examples and then attach all police activity to the same label.

    In this case the preacher is seeking an argument with the cop, and accuses the cop of unconstitutional behavior. The cop succeeds in garnering the info anyway.

  • I was actually agreeing with the civilian up until he started going into the conspiracy theory about Mcveigh @ about 8:55. The civilian was right to refuse to answer any questions, and thus provide ammunition for prosecution, BUT that was the end of my watching any further.

    Advice: quite while you're ahead. The cop was obviously trying to garner furthur information, and this civilian was giving him TONS of information. Might aas well wear a sign on your head saying "keep an eye on me".

    At 00:44, the officer attempted guilt by association.

    At 00:58, he admits that they ask people to prove their innocence "all the time".

    At 2;26, the officer shows that he doesn't understand the concept of presumption of innocence.

    I've also been interrogated like this by DPS, because I didn't wish to discuss my affairs. Interrogated for doing something completely legal.

    The cop would be wrong if his SOLE reason for stopping people was to determine destination, and whether someone had illegal possessions. Just don't answer.

The cop was doing his job by investigating in conjunction with a lawful stop. The officer retained the "authority" to arrest the driver if he so wished, and chose not to. But the officer has the "authority" to inquire as to the motives of those stopped to determine mitigating or aggravating circumstance. It's my opinion, and case law agrees with me.
