Dave was lied to and footage was the property of CBS was used to make money. I agree that Dave probably doesn't need the money but Joaquin obviously used Dave for publicity and will obviously make money off of Dave's image. As far as you using the content, legally you should pay royalties to CBS for making money off of their show but I'm pretty sure you're not even close to making it on their radar. I don't know you're income off this but judging by the chops, its nothing substantial

No he shouldn't be compensated. Copyright law is one of the largest obstacles to innovation in today. The ability to take material and synthesize is crucial to progress. As long as Pheonix and Affleck aren't just showing the Letterman episode without placing it in a different context than what was originally presented they ought to be within their rights. I doubt this to be the case under current law. This is one of the lesser reasons - out of a myriad - that the United States is declining.
