that's not an eternal magenkyo sharingan, that's just his version of the magenkyo sharingan just like kakashi has his own version as well, remember to have the eternal magenkyo sharingan one must have the eyes of another sharingan user but what happened with sasuke is diferent, itachi just gave sasuke his tecniques and when tobi asked sasuke why didn't he take itachis eyes he said that he did not want to take the same path as his brother
