    In subsequent proceedings, Judge Selna determined that the teacher was protected by qualified immunity and, on September 24, 2009, entered judgment denying the student declaratory, injunctive or monetary relief, and inviting the defendants to apply for recovery of their attorney fees and costs.

    Apparently the lawyer representing the student wants the supreme court to review the case if the appeals court doesn't repeal this ruling.

  • In my history class we learn this exact same thing, not nessisarily our teacher calling it non sense but it is the curiculum, they were probably learning about Russia or the USSR where religion was not approved during the communist rule, I think the quotes were used out of context.

  • Just realized I missed one of the comments brought up. The one with Aristotle was the THIRD comment and the second was against Christianity "When you put on your Jesus glasses you can't see the truth." Though it also seems anti-religion in general with the first part.

    Though I do not understand why it was not THAT comment that the judge cited as being against Christianity and instead used the creationism one.

  • Now if the teacher was disrespecting Christianity I could understand ruling in the kid's favor. The teacher was currently working at a (I'm assuming public) high school which is ran by the government which means they can't promote or demote (as demoting a religion is essentially promoting all others) a religion. But I don't see any quotes that show him doing that.

  • In addition, I like the second comment they bring up concerning Aristotle. Aristotle was born around 384 B.C. in Greece and, correct me if I am wrong, was no a Christian. So how would attacking Aristotle's beliefs be attacking Christianity?

    The first comment seems to be the only one of the three that even brings up God and it seems more like an attack on conservatives than on Christians.

    Also, there was no violation of First Amendment rights. Teachers do not themselves create or enforce laws, and so by extension cannot create or enforce laws that particularly favor or oppose specific religions. Was the teacher out of line? Perhaps. Not enough to sue the teacher though.

I would argue that the very existence of public schooling, and the department of education is a violation of out 10th amendment right to a limited federal government. "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Anything about education in the constitution? Than the feds can't do it.

  • @TheOrcasRule If we "needed" public education,on a federal level, we would have a constitutional convention, and the states would ratify a new amendment saying the federal government must provide, by taking money from people who work, to provide education for the children of those who don't. Kind of like what they did with income tax.

It's a class about EUROPEAN HISTORY and after being informed of the provocative nature of his class before enrollment, Chad brings Lawyers and audio tape. Chad Unlawfully recorded a lecture that was designed to provoke thinking about religion in history.

When a teacher takes opposition to the foundation for which these actions are justified that is admirable, its brave, its the right thing to do. 1 in 3 suicides are LGBT related. Not only is this as a direct result of religion but it pushes to put creationism alongside evolution in schools. Evolution is fact, not a belief.

  • @flameroller- I agree that the teacher was out of line with some of the comments, but to call creationism nonsense is actually a valid thing to say in a history class as history verifies that the Earth is not 6,000 years old (we have tools and cave paintings that are over 100,000 years old and civilizations that existed long before 4000 BCE). It also shows that there was no flood global 4000 years ago as many civilizations have an unbroken historical record and monuments built during that time.

I would be just as upset if a teacher at a public school started saying that if anyone here doesn't believe in jesus, they are going to burn in hell. You can't even have religion as a subject discussed in an enforced curriculum. Electives (aka non-mandatory) that deal with religion in an analytical way (such as a comparative religions course) would be acceptable. A lawsuit was a step too far, however.

    There was never a scientific consensus that the earth was flat. Science is based on empirical evidence. What empirical evidence has there ever been that the earth was flat? If you actually knew your history you would know that Eratosthenes demonstrated empirically that the Earth was indeed round in ~200B.C. or so. People didn't listen to him.

    The flat earthers were adhering to dogma instead of looking at data, kind of like creatinionists...
