It's funny because just yesterday I was having a discussion about frivolous law suits and I was thinking, yeah, it's out of control. Then I saw the author of Hot Coffee on Colbert and decided to do some research. I'm downloading the documentary now. I am also studying law. I find it amazing that I am so easily swayed back and forth on this issue. I can't say where I stand yet but I definitely find favor with the plaintiff in this case.
America need's to learn to study everything they hear carefully and stop trusting everything and living so innocently. The wool gathering days are over, don't buy from just anyone be selective. Learn to support good causes and lower the profits of these big corporations who don't respect the hard working middle class folks in our country, it's a silent war, a means of protest. Treat every media report as twisted, scrutinize all and vote in folks who are pro labor. This lady was a victim.
Ms Liebeck was 100% responsible for what happened to her...the judge should have dismissed it and made it impossible for them to bring it again...she would have taken it back if it were cold. I bet there were cupholders in her car too...why didnt she do the sensible thing and put it there? Hate stupid lawsuits like this!
Sadly, this case is being presented as a precedent in many law schools today, and I wouldn't be surprised if we had lawsuits in the future from people who don't know how to use knives properly - will we have to pay $100/knife to cover knife seller liability insurance? Or maybe we can start lowering liability costs (and hence health costs), have a more competitive free market, and be responsible for ourselves. What we need is Tort Reform!!!

During the next trial, the defendant's lawyers proved themselves incompetent, coming across a lot like your talented actor A. Hole. Furthermore the jury was incompetent, and their award of nearly 3 million was dramatically reduced by the judge. The whole trial was a joke, and even has an award named after it for the most frivolous lawsuit, the Stella Awards.

But a couple points: Liebeck's lawyers presented the jury with evidence that 180 °F (82 °C) coffee like that McDonalds served may produce third-degree burns (where skin grafting is necessary) in about 12 to 15 seconds, not 3.5 seconds as your video claims. How much time should she have had? Any coffee above 130 can burn, but then it's called "lukewarm" and no one wants to drink it. Mccie D's was merely guilty of serving what people wanted!
