this scene really shows the way the character thinks. if the criminal knows enough to see his gun is empty then he could have shot back. but Harry is reckless and himself feeling lucky because hes counting on the guys bloodloss and general fear into giving in, plus that it would be stupid for him to try to get away.
This scene is too hyped up and way over-rated by Hollywood and movie enthusiasts. I just got around to finally watching the scene, and I gotta tell ya, its not all that great. Werner Herzog describing this scene in Julien Donkey Boy was more exciting than the actual scene, and I'm not being sarcastic.

Some parts of the facades in this scene survived the fire a couple of years ago. If you ever take the tour, see if you can spot it along the way. This is Classic Eastwood!
