Their standing? That is what I dont understand. The police pull a person over and based on either his/her driving conduct or more commonly a smell of alcohol, the officer gets suspicious. Then the officer tries to confirm said suspicion by asking if the person will consent to field tests. If the person does as I suggest and refuses then the officer has to determine of he/she has probable cause to arrest based on what evidence exists. does this answer?
