She has not used an emotional argument. She has only shown the reality if the facts - a reasonable and rational thing to do - which elicits emotion in the consciences of properly ordered people.
In fact, the considerations of a beaten woman who faces financial hardship because of a pregnancy IS an emotional argument, as it appeals to a slanted and uninformed sense if pity and empathy.
What I love about the "Neurological capacity determines personhood argument" is that it doesn't slide into untenable positions. It is easy to stay consistent and its moral conclusions will lead us to right about where we find ourselves in US law. The more radical PC arguments can lead to one defending infanticide ( that can't be right ), and the radical PL arguments lead to defending fertilized eggs over real people ( a ridiculous proposal, intuitively ). Capacity & body autonomy - good combo!
Dr. Eike-Henner Kluge rocks my world. Honestly. He did an excellent job in a number of ways at arguing for the rights of persons, and debunking a number of logical flaws that Ms Grey has been throwing out there. Also: gotta say. His end note shoutout to non-human persons won me over.
There are so many holes and fallacies in Dr Kluge's argument! It's difficult to contain myself!
