  • People need to stop with the 7 witness recanted. First, there was a total of 34. Second, the 7 witnesses offered affidavits but never officially went into court which makes the affidavits immiscible as evidence. Thus why Troy was never given a retrial. His defense never got enough evidence to prove why he should. When you take a life without thought, yours should be taken. An eye for an eye.

    And one of the 27 witnesses who HAS NOT recanted was his ex-girlfriend who testified that he stopped at her place that night to change out of his bloody T-shirt.

Seen both black and white judges, parole boards and other judicial officers. There is no racism or any other bullshit excuse in this case. Clearly 20 years of appeals and hearings still got him a guilty verdict, so maybe just maybe he is actually GUILTY!

    2. Blood-stained blue shorts found in Davis' mother's dryer. (excluded by the judge because he ruled the search illegal)

People are arguing that if you don't know if a man is guilty, or you are just speculating, you are already taking his life by condemning him to X years in prison, there's no need to terminate him. I looked at the information just like anyone else. It's ambiguous. Therefore as a juror, I would have doubts. Based on doubts/justice not emotion, the death sentence would be commuted. No need to kill him, he will by naturally in prison.

  • This is so sad. Troy Davis was most likely an innocent man, and executed. How do you return life to someone once dead? We cannot ... and if nothing else, this is a very good reason the death penalty must be abolished once and for all.

    I hope Troy's death will help to reignite the struggles for human rights, and against capital punishment. We, as human beings, are capable of launching rockets into space ... yet we are still too primitive to come up with an alternative to killing someone.

  • @CherryBumsAderp You got it, reasonable doubt. If there's any doubt of innocence, juries tend to convict, but that's switching the burden of proof to the defense. Beyond a reasonable doubt is the standard for criminal cases, the highest standard there is. You don't know what evidence was presented in the Casey Anthony case, do you? And yes, eyewitness evidence is worth something, but it's proven to be the most unreliable evidence there is, and it is the #1 cause of wrongful convictions.

  • @CherryBumsAderp The ballistics "evidence" was discredited by forensics experts. It shouldn't have even been allowed into evidence at trial. No weapon was ever recovered althouth Cole admitted to the police that he possessed the same caliber gun used to kill the victim. And the Casey Anthony case was one of the rare instances where the jury followed the law. She might have done it, but the state couldn't prove it. You would want the same standard applied to you.

  • @matureamericanable It's simply not true that the appeals courts have found him guilty, becasue appeals are only based on the procedure of trial; they delivered no opinion whatsoever on the merits of the case. 3 of the jurors say that if they know now what they did then, the verdict would be Not Guilty. That means that without the police threatening witnesses to testifty the way they did, Troy would be alive and free today. You are the one who knows nothing about the case.

  • @lawyer4thepeople Ordinarily that would be true, but not in this case.The Supremes did something for this scumbag that they had not done for any death row con in 50 years.

    They don't usually concern themselves with guilt or innocence, but they gave Davis a hearing before a federal judge where his lawyers could present all this "new evidence"of his innocence. And after listening to it , the judge said bullshit.

    He said a lot more than that in his 170+ page decision. But the gist was bullshit

The evidentiary hearing still wasn't a decision based on guilt or innocence, and I believe, as several constitutional law scholars and legal human rights organizations do, that not granting him a new trial was the wrong decision. You're just one lonely bigot on this issue.

  • @matureamericanable Appeals are only based on procedure, not evidence of innocence, and innocent people frequently lose appeals as long as the trial had an appearance of fairness. With 7 of the 9 non-police witnesses recanting (one of those witnesses being the person 10 witnesses say actually committed the murder), no physical evidence of guilt, and new evidence of innocence, even the DA has admitted that he would not be able to meet his burden today.

    Troy Davis won in the court of public opinion because the jury consisted of anti-death penalty activists and well-meaning morons who knew NOTHING about the case except the bullshit and propaganda they heard from those anti-death penalty activists.

    Meanwhile he had 20 years of appeals in REALcourts ( state and federal) where facts and evidence - not bullshit and propaganda prevail.

    And he lost every time.

  • I feel for the families of Macphail and Troy Davis. Whether Davis shot Macphail is a possibility. If he was innocent, i feel both of these men paved the pathway for Americans to reconsider abolishing the death penalty. Prison is bad; scientists should be working on cures for these people. Would if these men were your brothers who did this? We don't understand the brain and our "junk dna", so how can we choose to destroy a life for convenience? Life's purpose is to love.

Regardless of that, the burden is on the government to prove beyond a reasonable doubt that the person is guilty; no one should have to prove their innocence. With 7 of the 9 witnesses recanting, new witnesses saying they saw someone else do it, and no physical evidence, the prosecution would not be able to meet their burden today. The state of Georgia murdered an innocent man.

  • He was guilty folks. Davis doesn't deny being at the scene. Fact is that either Cole or Davis killed the cop. Cole turned himself in, Davis fled town. The fact that Davis was able to successfully hide the gun, or the lack of "DNA evidence" when the two had no physical contact (he shot the cop from a distance) doesn't mean he was innocent. All available evidence points to Davis. Guilty and successfully graduated NU. The system works.

Can you IMAGINE this man raped and killed more than 300 kids (destroyed their parent's lives) - he got 22 years and... He's 55 now and he is about to get freed!!!

    well he is not MENTAL, he IS perfectly normal.. Psychological evaluation determined that the guy is normal.

    Take a look at Andres Breivik who gunned down 69 people in Norway, why did he do that? Because he knew that he is not in the United States where he will get grilled on an electric chair for that, but in Norway where the maximum allowed penalty is 21 years (no matter how much people you kill) he will also get his sentence reduced for cooperating with police.

ARE COLOMBIANS "BAD"? OF COURSE NO. Simply the maximum penalty available in Colombia is 30 years - so this people know they can get away with this!

  • Well this can't be black and white issue. 7 out of the 12 jurors were black and of his peer age. The guy had plenty off appeals, probably more than most other people would have had. All the defense had to do is cast a doubt. That doubt was not strong enough against the State's case. That's what it is.

    Ex 21:12 He that smiteth a man, so that he die, shall be surely put to death. (This is murder, not killing during war to protect our country.)

  • Sorry to say but this is a conspiracy. The justice system has failed many numerous times first by keeping that animal Charles Manson alive. He killed a pregnant woman and others for christ sake, all his evidence was in the courts but serves life w/o parol. On the other hand Troy Davis gets his life take off accusations, SERIOUSLY!!! where is the justice. Georgia is one of the few states that doesn't have to appoint to the supreme courts for consent of execution. It's unfornate for both families

  • which it was because they just took the life of an innocent man which is just as worst because the mother of the slain cop said “This Will Bring Closure.” How would this bring closure when you’re taking another life that’s just so fucked up in this case I really can’t even express it. The rate for execution rate by race in the United States is black males and Why’s that? Every black male or person does not cause trouble you have Caucasian male’s doing more killing and get less sentencing.

  • What Happen to the saying "Innocent Until Proven Guilty"? No justice what so ever. Troy Davis asked for a "Polygraph Test" Which violated his constitutional rights but he didn’t get what he asked for which is another slip in our system. This case had an wrongful doing and wrongful accusing of an innocent black male. We the people trusted the United States Justice system to handle and give us a rightful justice system this sicking act that the state of Georgia pulled to handle it was shit! :(

    So sorry this happened to him... Sylvester Coles should b ashamed, the jury should be ashamed, the people who witnessed against him should be ashamed, there was no kind of justice in this man case. In every other legal system you are innocent till proven guilty!!! this was not the case.
