The 14th Amendment original intent of the (14th) to the US & without question is misinterpreted to give citizenship to babies born in the US of illegals. These babies, via birthright citizenship, act as anchor babies & can, upon reaching age of majority, facilitate bringing extended family into the US in order to obtain citizenship. A Constitutional amendment would be necessary to remedy the misinterpretation & action is urgently needed to stop this abuse of R country by these leaches.
The constitutionality of birthright citizenship swings on the interpretation of a clause of the 14th Amndmt. "All persons born ... in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” The key phrase is "subject to the jurisdiction thereof". This has been interpreted to mean that all who are born here (w/ few exceptions) are considered citizens. Lets find out what the drafters truly meant by "jurisdiction".
The DREAM Act amnesty is, full of loopholes, wildly susceptible to fraud and does nothing to end the job magnet that allowed the parents to put these 'poor' kids into their position in the first place. AMERICAN tax dollars need to be used for AMERICAN citizens, period...NOT illegal immigrants.

Good point. My feeling is the proponents of this would argue only the children of citizens or legal immigrants can be citizens, but even if you go that route it, the first condition (citizenship) is citizenship by descent, and the second condition (legal immigrants) is citizenship by govt. decision. I don't like either one. Citizen by birth has flaws, but it's better than the alternative

Some don't. Japan doesn't, for example. And I seem to remember a lot of Americans accusing the Japanese of being racist xenophobes for not granting citizenship to ppl who are born there, or even to ppl whose parents were born there but didn't have the right pedigree.

I actually agree with him. Children born in the US to parents who are in the US legally (as landed immigrants, citizens, permanent residents, etc.) should be allowed citizenship. Those born in the US to parents who are illegally present should not be entitled to citizenship.

I've said this before, I'll say it again. Voiding birthright citizenship would apply to everyone, and everyone would have to "prove" they are an American Citizen. So if it isn't by birth, everyone would have to somehow "prove" they are citizens through process. I would count on having to go through that process every 6 months to a year.
Well actually, that's more of the reason why you couldn't functionally remove birthright citizenship, without pairing it with a massive amnesty program.

Sorry GOP, but birthright citizenship is a directly enumerated provision of the 14th Amendment (which you yourself pride yourselves on passing, by the way).
If you don't like it, propose a Constitutional Amendment and have it ratified by three-fourths of the states.
The 14th Amendment original intent of the (14th) to the US & without question is misinterpreted to give citizenship to babies born in the US of illegals. These babies, via birthright citizenship, act as anchor babies & can, upon reaching age of majority, facilitate bringing extended family into the US in order to obtain citizenship. A Constitutional amendment would be necessary to remedy the misinterpretation & action is urgently needed to stop this abuse of R country by these leaches.

"All persons born ... in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” The key phrase is "subject to the jurisdiction thereof". This has been interpreted to mean that all who are born here (w/ few exceptions) are considered citizens. Lets find out what the drafters truly meant by "jurisdiction".

My feeling is the proponents of this would argue only the children of citizens or legal immigrants can be citizens, but even if you go that route it, the first condition (citizenship) is citizenship by descent, and the second condition (legal immigrants) is citizenship by govt. decision. I don't like either one. Citizen by birth has flaws, but it's better than the alternative

Graham said this is a unique "problem" to the U.S. (the idea that ppl who are born in the U.S. automatically have citizenship.) That's not true. Most of the developed countries have the same policy. Some don't. Japan doesn't, for example. And I seem to remember a lot of Americans accusing the Japanese of being racist xenophobes for not granting citizenship to ppl who are born there, or even to ppl whose parents were born there but didn't have the right pedigree.

Really? So pregnant women travel through miles of desert to get here and have babies? The same desert that kills hundreds of immigrants a year that try to cross it. And the problem of deaths on the border has gotten so bad that border cities and towns organized to setup water stations in the desert to help prevent these deaths.

The problem here is that they want to open Pandora's Box. He said that birthright citizenship is a mistake, _PERIOD_. Illegal immigrants is a good Trojan Horse in that it is a sympathetic cause, and is fine at face value.
What this is all about is leverage, using citizenship to keep people in line. Imagine having to pay for your citizenship test, your card, and going through the process every year. And what would the process entail?

What I'd hope he's saying is that if the parents of a child are illegal aliens, then that child along with his/her parents must pass a citizenship test and all that stuff. I'm almost certain he would not say that ALL natural-born citizens should go through this process, that's just nonsense.

I actually agree with him. Children born in the US to parents who are in the US legally (as landed immigrants, citizens, permanent residents, etc.) should be allowed citizenship. Those born in the US to parents who are illegally present should not be entitled to citizenship.

I've said this before, I'll say it again. Voiding birthright citizenship would apply to everyone, and everyone would have to "prove" they are an American Citizen. So if it isn't by birth, everyone would have to somehow "prove" they are citizens through process. I would count on having to go through that process every 6 months to a year.

There are plenty of democrats who hate immigrants, and their are plenty of republican politicians (i dont know about the voters) who go easy on immigrants. bush was pretty easy on them, reagan supported amnesty. rick perry wants to secede from the union but he doesn't support the az law.
and in reality, obama is probably showing the least tolerance of any president since immigration became an issue.

Thousands of proposals have been made to amend the Constitution, only 33 obtained the necessary two-thirds vote in Congress. Of those 33, only 27 amendments including the Bill of Rights have been ratified since 1789.
