I agree with you, the constitutionality of the Federal Reserve is not the question here, its the moral imperative of the system. The consequential loss of liberties is the problem, and to be quite frank, Fiat systems really do create nothing more then empires.

One can argue that this does not limit the federal government from making something other than gold or silver legal tender.
Further although gold and silver are legal tender, voluntary exchange of other things is permitted in settlement of debts.
If FRN's weren't legal tender, which would you offer first in payment of your debts, gold or FRN's?
Nevertheless, the Federal Reserve System is by it's nature a threat to liberty, and is proven by it's history a thief of liberty.
