yes police officers can and due suspend constitutional rights all the time. Any arrest or search without a warrant is per se unconstitutional, but allowed with probable cause and in conjunction with case law. Officers must make these decisions all of the time and Cotton is simply saying you don't want bad apples making that decision so lets use the hiring process and compulsion to release past personal files from employers to weed out the bad apples.
