Not all CD keys would protect you from being prosecuted for owning an illegal copy of Windows. If you have a retail key, then yes, but not an OEM key because OEM keys can only be used with the hardware they were sold with. You also must have physical possession of the copy of the Windows that the CD key came with. If you buy a copy of Win 98, write down the CD key then resell it to someone else, then you are no longer the legal owner of that key. The buyer is.

Yes it is. Do you have any idea how long copyright terms last for? 75+ years, so Windows 98 is still under copyright protection and Microsoft CAN prosecute anyone who downloads it illegally. Some of the code in the old product may still be in use in the newer product and if they make the older product freely available then competitors will have access to at least some of the code that is in the newer product. The old product may also contain code that does not belong to them. Apple still distributes MacOS 7.5.5 but can't distribute 7.6.1 because some of the code belongs to others and Apple paid royalties for it. They can't distribute that code again without a new license

Just because a movie or book goes out of print for a long time doesn't mean someone might not buy the distribution rights at a later date and make it available again. @gamewizard what you say is true and right, but let me make an example: i own (really) two copies of "Microsoft MS-DOS 6.22 and Windows 3.11 for WORKGROUPS" in the 11 + 6 floppies package (whatever, they were a big pack disks), a windows 95 CD and a Windows 98 Upgrade CD. Two years ago i got nostalgic and assembled the old pc (still working since '93) and installed 3.11, but the first set of floppies was useless, because they lost their content due to age. Yesterday I downloaded all the three

@gamewizard but i don't think that is illegal for me... someone who had the original (the very same, except obviously for the product key) made a backup copy and uploaded it so everyone who had the original, but couldn't make a backup copy for any reason (unreadable floppy or cds, laptops without floppy drive...) could have one. Imagine if anyone did that and the last copy from microsoft were lost, we would have lost it. Period. Sorry, but i beleive in this (Fair use and copy)

It is illegal. Microsoft still owns Windows 98 and downloading an ISO of it breaks the law. Virtual PC allows the running of older software on machines with newer operating systems, but it does not give a license to pirate commercial software. Virtual PC is also used for security purposes because the virtual machine does not have full access to all the computer's hardware so viruses and trojans are less likely to be able to do any real harm.
