Clear thru the 1990s it was still LEGAL in West Virginia to SHOOT anyone found on your land. Whether it was posted or not, no matter the excuse was for being on the land. My friend in high school used to go hunting there when he was 16 with his dad and the grownups were adamant about staying put and not to go wandering around.
Another military guy to me his grandfather shot 6 people in his lifetime for being on his land in West Virginia.
In Wisconsin the trespass laws were just recently changed if you are on somebodys land then you are trespassing even if they say you can be there mainly because everybody and their brother mainly from the cities not the county so much will try to sue you if they get hurt and take you for all your worth i think it isnt a bad way to do it cuz the land owner doesnt have really any responsibility for people on their land
In canada we have crown land which is owned by the people and anybody at any time can go on it for as long as you want and do whatever you want as long as you're not harming nature in anyway, 48% of my home province is crown land.

I just checked Louisiana state law, it specifically says that criminal trespass requires a sign. It is truly amazing how little we know about our own written law. In most states, to prevent tresspassing, you must post visable signs of certain form, at certain locations, normally all along the perimeter of your property at given intervals, and many require you to even post a phone number of where you can be reached at. First, I am a motorcylist that loves camping. I own one of the largest "motorcycle only" camping gear stores in the country. Different states have different laws. In Louisiana, there is NO requirement to post your property, nor have it fenced or developed. Any person that is on another persons property, without consent is guilty under the law of tresspassing. There are exclusions for law enforcement officials and others, but the general public does NOT have a right to camp on MY property.
One is not guilty of anything without due process. Said process must include proof of criminal intent. Hence being on unposted land cannot be a crime until the occupiers are told to leave and refuse to do so. If the rules are different in Louisiana, it must a piece of the planet that is not part of US jurisdiction.

You are 100% correct. In most countries, with the exception of a very small number of statutory specifications, stealth camping would be regarded as something actionable only under civil and not criminal law. In some cases even that would be difficult.

In Scotland you can pretty much camp where ever you like. As long as you are respectful to the land e.g. not lighting fires on peaty ground, not disturbing crops or animals, then you can go anywhere and no one will stop you. He is exactly right. It is a basic principle in law that Trespass can only occur when informed . In other words with no signage and no verbal warning that the land is owned, no trespass has occurred. The owners must put up signage and be able to provide proof of ownership.

A man could go off into the woods and build a small little cabin and live off the land. I own land in a remote area of Mississippi . Use to people trespassed to camp out. I asked them to leave and they did. Only one guy gave me a hard time and I told him to wait there and I got a deputy to come out. Bad Attitude got himself strip searched; he left. That was back in the 80s.
Today people trespass to cook meth. I find the small camp fires, but no signs of people partying. I am always armed and should I see strangers on my property, I go ahead and call the sheriff's office.
What you decribe here is not stealth camping, but trespassing on your land. Mark it well as Private Property and law abiding citizens like myself will give it a pass. Be aware that REAL stealth camping when done well you would never be aware of. No cooking, no disturbing of property and we leave at dawn.

Then ure protected against poilice and also have the authority to chase off riff raff!

Meth addicts are dangerous when high. Dealers are usually addicts. Be careful. I have friend whom invested in motion sensors for the fenced portions of their property. Helped them tons. Hard to make drugs when 2-3 Marines/Soldiers come looking for you moments after you enter :)

@tonysshadow I believe it comes down to liability in the event of an injury or crime against the stealth camper. Parking lots are privately owned sometimes and are not considered camp grounds by definition. With the homeless in cars camping there for just a night's rest can leave the parking lot owner open to some serious financial loss in the event the stealth camper is injured or attacked. Good business sense demands the stealth camper must go someplace else to lower the risk of a lawsuit.
I discourage camping on agricultural land. It is illegal and there is tort law that allows the owner to sue for losses.
If you ask it's not stealth camping, so knowing the law is very important. Sadly many landowners don't really know the law, so it is often wise to avoid them.

stealth camping is not illagle its just you will run across areas etc that get of on giving homeless a hard time. walmarts encourage people to camp on there lots you don't need to be stealthy at all they figure you will come buy things so they do not care and the cops will not bother you. every walmart i go to you will find truckers and rvs camping.

Don't try it in Texas! After dark a landowner has the right to shoot you. Why stealth camp anyway? There are plenty of public owned areas for a lifetime of camping.

@griz public owned lands for the most part charge a fee. The entire movement of stealth camping exists to live as freely as possible....not just free in the sense of liberty, but to remove oneself fromthe burdens of more bills. Think back to 100 years ago. A man could go off into the woods and build a small little cabin and live off the land. FREE When he would purchase goods he would pay a tax, perhaps pay on his income, but if he doesnt need all the local services why should he pay any more?

Part of what I do requires me to do that sometimes. Its not as easy as one may think. that's my resp. on that point. On wildfires,most wildfires are started actually by homeowners statistically. I don't know if you just made up the trespasser factoid,but as a former NJ forest Fire Fighter I can tell u, you have no idea what ur saying

I own land in a remote area of Mississippi . Use to people trespassed to camp out. I asked them to leave and they did. Only one guy gave me a hard time and I told him to wait there and I got a deputy to come out. Bad Attitude got himself strip searched; he left. That was back in the 80s.
Today people trespass to cook meth. I find the small camp fires, but no signs of people partying. I am always armed and should I see strangers on my property, I go ahead and call the sheriff's office.

What you decribe here is not stealth camping, but trespassing on your land. Mark it well as Private Property and law abiding citizens like myself will give it a pass. Be aware that REAL stealth camping when done well you would never be aware of. No cooking, no disturbing of property and we leave at dawn.

@allanstokell When I used to own property the posting rules is about the same,but depending how much property u own this get a little expensive !!! Signs have to be visable and so many feet apart.Then u have people tearing them down.
I agree that alot of people would leave when ask but there are alot that dont and reck it for others.

@ministercreek You can camp on my land I live outside Baton Rouge and have a spot I pitch tent every now and then just to do it. Also have an argosy camper that I have a power cord run to it dont have the power and sewer hooked as of yet this will be done in the future for family that may want to crash for a week. The camper has heater I just close the windows and turn on one burner on the stove you will be sweating in 5 min if it is hovering around 35 out side. Ron Paul 2012.

@ministercreek Just got finished poping a tent in the front yard. Not for you I bought a recliner from Salvation Army I want to make sure it has no cooties so I will leave it in the tent till I can inspect it in the night with a good flash light. If they are in there I rather find out out there than in my home. If it has cooties I can just toss it out and I am out $50 or I have to find a way to raise the temp in the tent high enough to kill the cooties. 70769 is where I live.

@GJ I am really sorry to burst your bubble pal, but the camps already exist and the bill was footed by Homeland Security and FEMA in a joint venture. they are all near railroads and all sit with an open capacity of 95 % empty.Ok genius.what are they for? They call them residential centers and when asked why they are double fenced they have either no comment or swear it is for the "residents" safety.but all of the barbed wire is turned in to prevent escape not the other way. @snocamo154 yea meth is fucking everywhere yes theirs many people just trying to find a place to camp and get rest but the drug addicts have ruined it for many people. same issue hear my family owns tons of land in ky. we used to let the kids on atvs and even campers stay there we never ran them off. but then the atv kids started going off the tails messing up stuff etc and the hunters started just killing shit and leaving it. we now kick them off are land as well.

@ssj4goko4 Try seeking out the property owners as I have in a few locations and get to know them a bit. Let them know that not only are you not a threat, but you can offer to watch out over property that goes much unseen by the owner. Be an asset and offer a little help for permission . Valuable long term friendships like that can be seriously valuable, especially if they are willing to write you a note. Then ure protected against poilice and also have the authority to chase off riff raff!

@snocamo154 Just replied to someone about this very issue. Older property protection laws in certain areas that were in place for a far different reason are helping with this. Meth addicts are dangerous when high. Dealers are usually addicts. Be careful. I have friend whom invested in motion sensors for the fenced portions of their property. Helped them tons. Hard to make drugs when 2-3 Marines/Soldiers come looking for you moments after you enter :)

If you don't, you will get to meet a sheriff's deputy and have charges of trespassing brought on you. In Ontario, the provincial government allows municipalities to regulate parking.
I'm not sure how this relates to stealth camping as with stealth camping no one knows you are there because you are invisible.
I don't see that is possible when parking a vehicle in a parking lot.

Thanks for your effort. To me, an even more outrageous sin against freedom is when town govs tell folks, you cant park in a parking lot overnight. Thats almost right out of the Twilight Zone. First, we are talking about private property...Second we are talking about property specifically and generously set aside for patrons to park. Where does government enter the equation if not called by the owner? Answer Nowhere!

@tonysshadow I believe it comes down to liability in the event of an injury or crime against the stealth camper. Parking lots are privately owned sometimes and are not considered camp grounds by definition. With the homeless in cars camping there for just a night's rest can leave the parking lot owner open to some serious financial loss in the event the stealth camper is injured or attacked. Good business sense demands the stealth camper must go someplace else to lower the risk of a lawsuit.

I discourage camping on agricultural land. It is illegal and there is tort law that allows the owner to sue for losses.
If you ask it's not stealth camping, so knowing the law is very important. Sadly many landowners don't really know the law, so it is often wise to avoid them.
