I went back & looked at the 1/8 episode & the room they were in is the same room as the room they're in in this episode, but the furniture & layout are different. Not sure why. In that episode there was a guard standing over Rafe but in this one the guard leaves them alone. It may just be a simple continuity lapse, or to give the viewer a sense of Rafe's impending freedom, or as you mention, it might be because of Frank. I think it was continuity lapse.
