  • if all you listen to is pop music then yes this is'nt going to sound like paramore, because you surround yourself in pop music you'll be able to tell the difference, but someone like me that listens to metalcore, progressive metal, classical, smooth jazz, underground hip-hop, RnB, Soul from the 60's and 70's, dubstep/filthstep, vocal trance, punk/ska, reggae/dub, and is so diverse in their music is going to say yes this sounds exactly like paramore.

  • @eveningninja commercial successful bands is the definition of "best" bands. the way your using "best" is just as an opinion. your opinion that bands with female leaders are many of the best bands is just an opinion, nothing more. however, bands like linkin park can be considered one of the best bands of all time since millions of people listen and like them. even if they made no money at all, they could still be considered one of the best bands, based on the millions of people loving them.

    Businesses marketing a band to be commercially successful has little to do with its direct musicality. As soon as you realize THIS, you'll realize you're arguing a different point that isn't even relevant to my original statement.

  • It's been stated 'Prevail doesn't market their music' none of their material is available outside of hawaii...with this statement alone the entire argument is rendered invalid. The fantastic theory that Darling Parade magically found this song a year after they had written their own version is outlandish. These conspiracy scenarios are quite entertaining, but are as believable as the drunken rantings of an alien abduction theorist.

  • @awaide88 Prevail has a myspace (lol, that site still exists? surprise!) and people visit hawaii all the time, so I'm sure CDs and videos have gotten around places. It probably IS unlikely, but the chances of Prevail stumbling upon DP when their first CD first came out are also not that big either. I'm pretty sure these videos werent all over youtube back in 2008 either.

  • @finaleus My bad, I removed my comment because I read yours wrong. Prevail uploaded their version April 5, 2010 on myspace. Darling Parade had already recorded and federally copyrighted the song a year earlier. Not to mention, bands don't do big time recordings like Bells Are Ringing is until they have played it live a LOT. I would say this whole situation is unlikely, but the facts show far less likely that DP is to blame.

  • @s2thalayer Okay, I can't say that I can deny anything you said in your comment. Prevail has played the song before the recorded as well, but you're right... from a perspective without any sort of bias, DP clearly has the rights to the song and Prevail is most likely wrong. I'm still not going to change my opinion, but that's how this will probably end (hopefully without a crapload of arguing).

    I'm at least glad that your defense in DP is actually legitimate, unlike some of the other haters.

  • @finaleus I'm a realist. I like to think I base my opinions on fact and understanding both points of view rather than pure emotion like a lot of our fellow youtubers. I wish this would all just end and Hawaii could have their Heart Beat and the rest of us can have our Bells Are Ringing...but I know it's too late for that now.

  • If anything, Prevail is helping DP, because no matter who stole it, it is DP who is getting all the attention from this. There's no need to hate on the band that is helping DP get views. Did you notice the views on this vid have shot up since the whole ordeal?

    Don't hate on either band no matter what you believe. Stealing sucks, but hating without actually knowing shit for yourself is worse.

  • Can all of you DP fans calm down and look at this logically for a second?

    If you stole another band's song that they had copyrighted, you would NEVER come back to them years later to complain about it. Prevail does not sell anything of their merch online, so they clearly aren't trying to get attention with this. However, if you found out that some other small band stole your song via facebook years later, I'm sure you'd complain too, whether or not you copyrighted it first.

  • @finaleus Prevail didn't come at them, fans of Prevail brought it to Prevail. That puts Prevail in a spot to defend the song or lose all credibility. Maybe it goes too far and gets where it is today. That argument doesn't prove anything, much like all the other dead end arguments and logic everyone is trying to put together. The simple fact is, right or wrong, believe it or not, copyright laws were put in place to settle this exact scenario. It's how the system works.

  • @s2thalayer I know that DP has the copyright for the song, and so does Prevail. They screwed up when they didn't protect their music... so if they're going to get hurt for it, then that sucks... lesson learned for them.

  • @finaleus Dual ownership for copyright does not exist. Federal copyright overrules assumed copyright. A copyright that isn't registered federally isn't worth the paper it's not written on. But yeah, I agree with what you said. If they did in fact right it, they screwed up, lesson learned.

  • @finaleus Don´t we all try to compare upcoming things to things that already exist? In my opinion this song could have been written by Paramore too. Paramore has it´s leadership in this segment of music, so it´s obvious to use them for comparison. And if you say DP does not sound like Pm, it´s just your opinion. Never the less Darling Parade wrote a good song. Let´s stick to this.

  • @Crusherle Not trying to argue you to the ground, and I respect you used "In my opinion". However, from a different point of view here, Josh Farro's guitars are (were) extremely simplistic. That's fact. These definitely are not. Zach Farro's drums were way different than this. Hayley's vocal style is night and day different. Darling Parade has a lot of country sides to their stuff, where as Paramore doesnt, even though they both originate from TN.

  • Darling Parade is an insanely talented band! I am so lucky to know them all personally. They are some of the kindest, most trustworthy people I have ever known. From the recording studio to the stage I have seen this band put their blood sweat and tears into their music. Every lyric and every note with a piece of their heart attached to it, just to be given away on stage. If you ever have the chance to see them live you will feel Kristen's passion flowing through her voice into the world.

  • Is it possible that Prevail ripped the song when Darling Parade were posting teaser tracks of the song using the chorus for the teaser back in the days of MySpace??? If you look back this band had nothing like this song up then and of course did not have this song up at all until after Darling Parade had already Recorded, Copyrighted, Posted with BMI, Released on Itunes and Posted on there MySpace! No proof on Prevails side just, "I was there" "I know the band" "we wrote it"

  • They have also stated the following, Ours was written in June of 2008, recorded in January of 2009, and released in May of 2009. The earliest recording we have of this song is July of 2008. We have never been to Hawaii. None of us. So if they didn't release the song before July '08.....Case closed.

  • Hmmm very unknown band mysteriously appears out of nowhere with a claim that "popular" band Darling Parade copied their song....First off let me say I tried to research this other band before I drew a conclusion, but you know what it was as hard as hell to find anything about them... It just seems strange Darling Parade has had this song out for a hot minute and nothing has been said up til this point. As they are about to go on a nationwide tour... I think I smell jealousy.

I mean, it'll cost them up to $30,000, or up to $150,000 if they knew they were copying Darling Parade's song when they did (extent to which the infringer disregarded the property rights of the owner). But I'm sure it was worth it.

  • I have no way of saying who ripped of who - I'd never hear of either band before now, as I was linked from a third party. But I will say the arguments being used by DP fans mean nothing. Registering copyright means that no-one else has previously done so, but not everyone does register their copyright (it's automatic, registering just makes it stronger), and more popular artists have been known to steal off unknowns, because they can get away with it. Not taking sides, just saying.

  • @MissGreyDay This is not true at all. If this is what you believe, you need to study copyright laws a bit closer. Copyright must be registered and filed in the Library of Congress to exist. If not done so, you do not own your own idea. It is a simple process, and a common thing to think it is automatic but it, in fact, is not. Even if Prevail did write the song first, they do not own it because they did not register copyright. This is not opinion or debatable. This is the law.

  • @s2thalayer I've got the laws up in another window. They state that copyright exists as soon as a work comes into existence (in this case, as soon as the song was written). It's just a good idea to register it because it makes it stronger, and gives you a better case if someone does steal it.

However, I don't get the purpose of even having a copyright if you are not entitled to statutory damages or the ability to file a lawsuit for infringement. Anyone who has the registered copyright trumps the other.

But either way, Darling Parade registering the song doesn't mean they wrote it, and if Prevail can prove they did that would make DP look like pretty awful people regardless of the law.

I play in a band from Honolulu not gonna name which one, but we have played with Prevail before and all I can say is this is giving Hawaii's music scene a bad rap not that Hawaii music was even big to begin with. Everyone should just smoke a joint and get over it haha if only things were that simple.Even if this song is ripped from either or I bet you bands can write way better song then this anyways. We had thousands of fans and national attention at that time, and it's still near impossible to find the other artist online today. None of us have ever been to Hawaii. We're just sticking up for a band and friends that we know. DP says they had the help writing the song from their producer. So even if the members of DP didn't steal lyrics, melody, AND riff from Prevail, it's way too much of a coincidence. And obviously the producer needs to be questioned.

I've been working in the music industry for 10 years, and I've worked with bands like Augustana, Future Leaders of the World, Throwing Gravity etc...  The band came to me with the rough idea for Bells are Ringing and we re-wrote it together during pre-production before we went into the studio. We changed a lot of lyrics and melody and basically made it a new song. Until yesterday, I had never heard of PreVail. I've never been to Hawaii.

  • @dylasauruswrecks DP didn't screw up... if Prevail simply wanted to fix this situation, they should have just contacted Darling Parade directly via Facebook or whatever. Instead they called an all out war pushing for their fans to go crazy and let everyone know what was going on. Not very professional of a local band to act to another local band. Darling Parade is a local Nashville band... so this game that is being played claiming that "the big band DP copied our stuff" is unbelievable.

I get that but dude understand prevail is from Hawaii, the music scene here is a very close knit group like family. I truly and honestly believe prevail wrote the song first but they have to pull a copy of their song time stamped on a website or something before 08. Till then everything is up in the air.

  • @andyspam85 It was copyrighted back in 08 but copyrights can be disputed there is a sentence saying its a pending legal matter so if prevail can bring up evidence they can probably claim a "Poor mans copyright" they could state that darling parade stole their stuff. Although it isn't usually legally held up in US courts could still be ammunition for an argument.

Prevail made the mistake of not copyrighting their song when they made it. Lesson learned. I think it is pretty underhanded to say the least.

  • Living on a rock makes it hard to get word out as a band, I feel it is a really low blow to steal a song that a band wrote from their heart then having it used as the song propelling another band forward in the music world, have you noticed the rest of their songs don't even break 1300 views? This is coming from Nashville TN the music capital of the world too. At this point it is giving credit where credit is due.

  • @prevailsucks really? Youre going to compare the "number" of fans? Prevail is on a rock, with limited spots to play, while Darling Parade is in the music capital of the country. They can go anywhere on the east coast in a matter of time with little money. While Prevail lives in paradise and it will cost at least $3000 to get their band to the mainland. Now im on Prevails side, but i dont think we should go around talking crap about Darling Parade, and Darling Parade fans shouldnt be talking crap about Prevail. There are a number of things that could prove that, but I'll just leave you with this one: Prevail has a little over 800 likes on Facebook, while Darling Parade has over 18,000. Looks like PreFAILl is lacking a couple of digits. And it also looks like PreFAIL is just trying to market themselves. They should just stop while they are ahead, because they suck. Big time.
