if all you listen to is pop music then yes this is'nt going to sound like paramore, because you surround yourself in pop music you'll be able to tell the difference, but someone like me that listens to metalcore, progressive metal, classical, smooth jazz, underground hip-hop, RnB, Soul from the 60's and 70's, dubstep/filthstep, vocal trance, punk/ska, reggae/dub, and is so diverse in their music is going to say yes this sounds exactly like paramore.
Links, please, to their stuff...this isn't bad, but if it's a cover and they have their own stuff I'd really like to be able to get to it from here....just sayin'

Metal? This definitely isn't metal. Maybe alternative or pop-punk. There arent any palm mutes, arpeggios, sweeps, double bass, heavy vocals, guitar solo's, nothing resembling metal around here.
@bendfork it sonds nothing like paramore!!! i dont understand why people compare any band with a lead girl vocalist to paramore. paramore is like my number one favorite band and this is nothing like paramore

@pyqmxbdshc they sound nothing like paramore paramore is like kinda slower now and they kinda hit a dead end with their last album. all becouse bands have a chick lead singer doesnt mean they are like paramore
@eveningninja you cant call a band a best band until they have tons of great critic reviews and are popular throughout the world. a more accurate version of your statement would be "i like bands with female leads" just because you like them doesnt make them a best band.
@eveningninja commercial successful bands is the definition of "best" bands. the way your using "best" is just as an opinion. your opinion that bands with female leaders are many of the best bands is just an opinion, nothing more. however, bands like linkin park can be considered one of the best bands of all time since millions of people listen and like them. even if they made no money at all, they could still be considered one of the best bands, based on the millions of people loving them.
@Sairyoku00Udemae Of course it's an opinion, but it is still a more accurate description. Being mainstream has much more to do with marketing tactics than anything else.
@eveningninja to put it simpler for you, because you think female lead bands are the best bands , that does not actually make them a best band just because you think so. that is my point and the one im trying to argue. once you realize that then the argument is done.
@Sairyoku00Udemae There's only going to be one way "best" works in the case of judging music, and that is obviously subjectively. Why do you think I responded directly to misterbillg1990? I wasn't broadcasting this is a fact to the world.
Businesses marketing a band to be commercially successful has little to do with its direct musicality. As soon as you realize THIS, you'll realize you're arguing a different point that isn't even relevant to my original statement.
@Sairyoku00Udemae Quote>>considered one of the best bands, based on the millions of people loving them.
Quote>>because you think female lead bands are the best bands , that does not actually make them a best band just because you think so
Unless millions of people are thinking the same thing eh?
Doesn`t it also mean that just because millions of people think that the band is best doesn`t mean it`s the best band because it`s just an opinion of a million people and doesn`t prove anything?
DARLING PARADE is sick! I've loved this song ever since I first saw them back in 2008! I can't wait for their tour next month with CASSADEE POPE of Hey Monday! Listening to this song is getting me stoked for the next time I get to see them live!!!
It's been stated 'Prevail doesn't market their music' none of their material is available outside of hawaii...with this statement alone the entire argument is rendered invalid. The fantastic theory that Darling Parade magically found this song a year after they had written their own version is outlandish. These conspiracy scenarios are quite entertaining, but are as believable as the drunken rantings of an alien abduction theorist.
@awaide88 Prevail has a myspace (lol, that site still exists? surprise!) and people visit hawaii all the time, so I'm sure CDs and videos have gotten around places. It probably IS unlikely, but the chances of Prevail stumbling upon DP when their first CD first came out are also not that big either. I'm pretty sure these videos werent all over youtube back in 2008 either.
@finaleus My bad, I removed my comment because I read yours wrong. Prevail uploaded their version April 5, 2010 on myspace. Darling Parade had already recorded and federally copyrighted the song a year earlier. Not to mention, bands don't do big time recordings like Bells Are Ringing is until they have played it live a LOT. I would say this whole situation is unlikely, but the facts show far less likely that DP is to blame.
@s2thalayer Okay, I can't say that I can deny anything you said in your comment. Prevail has played the song before the recorded as well, but you're right... from a perspective without any sort of bias, DP clearly has the rights to the song and Prevail is most likely wrong. I'm still not going to change my opinion, but that's how this will probably end (hopefully without a crapload of arguing).
I'm at least glad that your defense in DP is actually legitimate, unlike some of the other haters.
@finaleus I'm a realist. I like to think I base my opinions on fact and understanding both points of view rather than pure emotion like a lot of our fellow youtubers. I wish this would all just end and Hawaii could have their Heart Beat and the rest of us can have our Bells Are Ringing...but I know it's too late for that now.
If anything, Prevail is helping DP, because no matter who stole it, it is DP who is getting all the attention from this. There's no need to hate on the band that is helping DP get views. Did you notice the views on this vid have shot up since the whole ordeal?
Don't hate on either band no matter what you believe. Stealing sucks, but hating without actually knowing shit for yourself is worse.
Can all of you DP fans calm down and look at this logically for a second?
If you stole another band's song that they had copyrighted, you would NEVER come back to them years later to complain about it. Prevail does not sell anything of their merch online, so they clearly aren't trying to get attention with this. However, if you found out that some other small band stole your song via facebook years later, I'm sure you'd complain too, whether or not you copyrighted it first.
@finaleus Prevail didn't come at them, fans of Prevail brought it to Prevail. That puts Prevail in a spot to defend the song or lose all credibility. Maybe it goes too far and gets where it is today. That argument doesn't prove anything, much like all the other dead end arguments and logic everyone is trying to put together. The simple fact is, right or wrong, believe it or not, copyright laws were put in place to settle this exact scenario. It's how the system works.
@s2thalayer I know that DP has the copyright for the song, and so does Prevail. They screwed up when they didn't protect their music... so if they're going to get hurt for it, then that sucks... lesson learned for them.
@finaleus Dual ownership for copyright does not exist. Federal copyright overrules assumed copyright. A copyright that isn't registered federally isn't worth the paper it's not written on. But yeah, I agree with what you said. If they did in fact right it, they screwed up, lesson learned.
@Crusherle and no, it doesn't sound like Paramore. At least you're trying to compliment them, but people who always compare bands to paramore need to get their ears checked.
@finaleus Don´t we all try to compare upcoming things to things that already exist? In my opinion this song could have been written by Paramore too. Paramore has it´s leadership in this segment of music, so it´s obvious to use them for comparison. And if you say DP does not sound like Pm, it´s just your opinion. Never the less Darling Parade wrote a good song. Let´s stick to this.
@Crusherle Not trying to argue you to the ground, and I respect you used "In my opinion". However, from a different point of view here, Josh Farro's guitars are (were) extremely simplistic. That's fact. These definitely are not. Zach Farro's drums were way different than this. Hayley's vocal style is night and day different. Darling Parade has a lot of country sides to their stuff, where as Paramore doesnt, even though they both originate from TN.
Darling Parade is an insanely talented band! I am so lucky to know them all personally. They are some of the kindest, most trustworthy people I have ever known. From the recording studio to the stage I have seen this band put their blood sweat and tears into their music. Every lyric and every note with a piece of their heart attached to it, just to be given away on stage. If you ever have the chance to see them live you will feel Kristen's passion flowing through her voice into the world.
@andyspam85 ...Except for this song....it would be smart to remove this one from their profile since it's not theirs. Since they have plenty of other songs, why do they need one that's not their own? Besides, it's not anywhere near as good a version as the original....
@finaleus Prevail and their fans started this. They attacked DP both personally and professionally. Why do you think DP fanatics need to chill? Prevail threw the first stone. We are just defending our friends because it,s a fact Prevail are liars.
This comment has received too many negative votesshow
PREVAIL is from a small island called Hawaii. We barely have places to play at, cheap recording gears, etc. But we are SURE that NO BAND FROM HAWAII STEALS OTHER BAND'S SONGS, especially Prevail. We know them personally, share our daily lives with them as they write their songs. We completely know what we're fighting for. While you faggots consider yourselves as fans, we consider ourselves as family. K A R M A will get to you all, and to THIS BAND. Good luck on that. WE WILL PREVAIL.
@TheErikka5 Karma also gets to people who spray hate on the internet as an argument rather than facts, or to just sound tough...or maybe both. We're all intimidated. -_-
At least darling parade posted there copyright! Prevail has shown nothing but a video that was posted way after all the info DP has provided. These are the facts look it up! If you look up the producer he is well known and published! Really stupid of Prevail to rip DP and go after a published writer! You just begging for things to go bad!lol
Is it possible that Prevail ripped the song when Darling Parade were posting teaser tracks of the song using the chorus for the teaser back in the days of MySpace??? If you look back this band had nothing like this song up then and of course did not have this song up at all until after Darling Parade had already Recorded, Copyrighted, Posted with BMI, Released on Itunes and Posted on there MySpace! No proof on Prevails side just, "I was there" "I know the band" "we wrote it"
They have also stated the following, Ours was written in June of 2008, recorded in January of 2009, and released in May of 2009. The earliest recording we have of this song is July of 2008. We have never been to Hawaii. None of us. So if they didn't release the song before July '08.....Case closed.
Also, we have the email that we sent to our producer for consideration in mid-late 2008. So you are saying that they had a copy of the song online at that time? Just wondering here man because your undocumented/ill-advised facts aren't lining up. I will say this one more time. This will end with the truth coming out, and you will be on the wrong side of it. It is better for you and your band if you stay out of this.
Just some things to think about people! Saw Darling Parade posted this.
The fact is that we have provided our proof. Not to mention the fact that if you go on iTunes we released that cd in may of '09.(not 2010 like you claim) Do you know when prevail released theirs? Because if it was after that then you are saying that we must have gone to Hawaii and heard them live? Sorry my friend, Hawaii is beautiful and we've always wanted to go, but none of us have ever been there.
Hmmm very unknown band mysteriously appears out of nowhere with a claim that "popular" band Darling Parade copied their song....First off let me say I tried to research this other band before I drew a conclusion, but you know what it was as hard as hell to find anything about them... It just seems strange Darling Parade has had this song out for a hot minute and nothing has been said up til this point. As they are about to go on a nationwide tour... I think I smell jealousy.
@gingaj87 there's no jealousy. we are simply confused as to why such a "big" band would steal, thats right STEAL a smaller band's music. look up the fucking song heart beat by prevail. that song was written in 2008. way before this song. you guys are blinded fans. think realistically and get off their dicks.
not doubt who wrote this song, I have been following DP for years, they have too much talent to be stealing a song from a band with none. Keep rocking guys, we will catch you on your tour!
@caitlynjoy87 Your a dumbass I wasn't even being serious. I was lightening up the comments being that all of them are so negative. So excuse me you get YOUR fact straight before saying anything. I know Tom Delonge has nothing to do with this band dipshit. Get a sense of humor.
Dude this guy who says this song is stolen is either A, fucking high, or B, just trying to stir shit. Oh how people get hard ons over arguing on the Internet. I personally know these guys and know for 100% fact this isn't stolen. Haters gonna hate.
@bigboybeard It was an awesome way to get exposure though at someone else's expense huh? I mean, it'll cost them up to $30,000, or up to $150,000 if they knew they were copying Darling Parade's song when they did (extent to which the infringer disregarded the property rights of the owner). But I'm sure it was worth it.
I have no way of saying who ripped of who - I'd never hear of either band before now, as I was linked from a third party. But I will say the arguments being used by DP fans mean nothing. Registering copyright means that no-one else has previously done so, but not everyone does register their copyright (it's automatic, registering just makes it stronger), and more popular artists have been known to steal off unknowns, because they can get away with it. Not taking sides, just saying.
@MissGreyDay This is not true at all. If this is what you believe, you need to study copyright laws a bit closer. Copyright must be registered and filed in the Library of Congress to exist. If not done so, you do not own your own idea. It is a simple process, and a common thing to think it is automatic but it, in fact, is not. Even if Prevail did write the song first, they do not own it because they did not register copyright. This is not opinion or debatable. This is the law.
@s2thalayer I've got the laws up in another window. They state that copyright exists as soon as a work comes into existence (in this case, as soon as the song was written). It's just a good idea to register it because it makes it stronger, and gives you a better case if someone does steal it.
@MissGreyDay Therefore, you are half right. I minored in business law and I'll admit i didn't know copyright existed automatically. However, I don't get the purpose of even having a copyright if you are not entitled to statutory damages or the ability to file a lawsuit for infringement. Anyone who has the registered copyright trumps the other.
@s2thalayer Hmm, I thought if a band could prove they wrote the song then they would have a case, just not as strong it could be. I'm not sure on that one though. But either way, Darling Parade registering the song doesn't mean they wrote it, and if Prevail can prove they did that would make DP look like pretty awful people regardless of the law.
@MissGreyDay and vice versa, which is much more likely. Sure, it's possible Prevail wrote it. It's also possible that I'm killed by a random sniper serial killer before I finish typing this message. To believe they wrote it, like most conspiracy theories, you have to take fact and evidence out of the equation and push rational belief aside to trust that the unlikely happened. One band has a recorded version of the song in 2010, the other in 2008 and has never been to Hawaii.
@MissGreyDay Oh no, you're fine. I enjoy *talking* about things in youtube comments. What I hate is when someone sends a personal hate comment back about how im a fag and should go die in a fire because I like to see the facts before I make a decision. That's not talking. haha.
So if Prevail sees this or DP we should just make peace and move on. Let both songs Coexist this world is already to messed up to have something like this bother everyone. I like both versions of the songs and maybe one day Darling Parade can come down to Hawaii and play a show. So please just let it go guys.... It's not even worth it.
@RockTheGanjah45 But Prevail deserves the credit. Why should this band get all the money from something Prevail personally wrote? Stealing is wrong. That's the whole point.
@CrossroadRebels Ha, you think DP is making money off this song? From where? It has no placement, and the EP it's on isn't even in circulation. Despite the popular Hawaiian belief, DP is not some rich and famous band. They are however 4 hard working musicians who support themselves and the band with crappy day jobs.
This comment has received too many negative votesshow
@andyspam85 As a fan of both DP AND Prevail, I can say that I believe DP is at fault for this, not Prevail. I still respect both bands, but I'm pretty sure Prevail wouldn't pull this shit, and I've actually met them in person back when I got their CD years back. And btw, your argument is flawed:
DP has this EP on itunes, so they are definitely getting money off it. As someone who bought it, I would know.
I'm not going to hate either band, but I think you DP fanatics need to fucking chill.
@CrossroadRebels stealing is wrong. which is why Prevail will get whats coming to them. they only thing Prevail "personally wrote" was a trashed copy of Darling Parade's originally masterpiece
Omg this is the stupidest thing in the world lol. I play in a band from Honolulu not gonna name which one, but we have played with Prevail before and all I can say is this is giving Hawaii's music scene a bad rap not that Hawaii music was even big to begin with. Everyone should just smoke a joint and get over it haha if only things were that simple.Even if this song is ripped from either or I bet you bands can write way better song then this anyways. Peace and love and unity thats waht music is.
@jesesrulezdood that is untrue. We have never received anything from them. In fact when this all started last night we posted two different email addressed for contact and they have still declined to contact us using any direct/civil means.
It's not just "why?" it's "how?" there was literally no released recording of this illedged song at the time we recorded the real version. We had thousands of fans and national attention at that time, and it's still near impossible to find the other artist online today. None of us have ever been to Hawaii. But we are supposed to believe that it's more likely that we found them(which we could barely even do last night), and stole their song, before it had even been record by the artist in questi
Just keep your heads up DP. This level of maliciousness and hate only means one thing, you're being noticed. People always try to take out competition, and bitterness is a poison.
I can't believe the ignorance going on here. You do realize that every comment made has done harm to Prevail? Whether its a joke or you guys really think you're entitled to the song, DP has shown copyright. You are actually TURNING PREVAIL IN for copyright infringement. It can all be used in court against them. It's not about what's wrong or right, it's a legal issue, and these kids are about to get in some serious trouble if things don't stop.
@blacknovember23 just like you're being right now yeah? Some people were rude, yes. And that was wring. Im not sating what they said was right. But not everyone was rude. We're just sticking up for a band and friends that we know. DP says they had the help writing the song from their producer. So even if the members of DP didn't steal lyrics, melody, AND riff from Prevail, it's way too much of a coincidence. And obviously the producer needs to be questioned.
@Ashleeroks Hi Ashlee, I'm Darling Parade's Producer. I've been working in the music industry for 10 years, and I've worked with bands like Augustana, Future Leaders of the World, Throwing Gravity etc... The band came to me with the rough idea for Bells are Ringing and we re-wrote it together during pre-production before we went into the studio. We changed a lot of lyrics and melody and basically made it a new song. Until yesterday, I had never heard of PreVail. I've never been to Hawaii.
@dylasauruswrecks DP didn't screw up... if Prevail simply wanted to fix this situation, they should have just contacted Darling Parade directly via Facebook or whatever. Instead they called an all out war pushing for their fans to go crazy and let everyone know what was going on. Not very professional of a local band to act to another local band. Darling Parade is a local Nashville band... so this game that is being played claiming that "the big band DP copied our stuff" is unbelievable.
@blacknovember23 Prevail did contact them first, they sent them a message. They didnt want this to happen, but then some fans found out from both sides and started bashing each other.
@Ashleeroks something I don't know?! really? Get over yourself! of course they will delete the negative comments! They were extremely rude and uncalled for.

It's pretty plain what's going on. One of these two bands stole the other one's song. That much has been established. Here's why people seem to think that it's DP's song: facebook.com/photo.php?fbid=10150542350520859&set=a.425464940858.197924.97311865858&type=1&ref=nf DP has copyrighted it.
Ok but big deal. My band played with Prevail years ago like early 2008 and they played that song. I know that DP copied it, I'm certain. Paper is paper but DP knows they fucked up. They should be ashamed.
This comment has received too many negative votesshow
@blacknovember23 they're deleting all of the pro Prevails comments off their fb not YouTube. Prevail seriously wrote this song. There's no doubt about it. Why don't you fly to Hawaii and check them out instead of talking about something you dont know.
@deleon1619 could you blame them if they were deleting the comments? but they aren't... this is a fan's video and this is not their official Youtube channel.
@blacknovember23 They also delete the pro prevail comments off of their facebook and block them from their page too. I get that but dude understand prevail is from Hawaii, the music scene here is a very close knit group like family. I truly and honestly believe prevail wrote the song first but they have to pull a copy of their song time stamped on a website or something before 08. Till then everything is up in the air.
Hmm it seems DP has posted proof that they own this original song. facebook.com/photo.php?fbid=10150542350520859&set=a.425464940858.197924.97311865858&type=1&ref=nf
@andyspam85 It was copyrighted back in 08 but copyrights can be disputed there is a sentence saying its a pending legal matter so if prevail can bring up evidence they can probably claim a "Poor mans copyright" they could state that darling parade stole their stuff. Although it isn't usually legally held up in US courts could still be ammunition for an argument.
@deleon1619 I supposed it can be disputed. I bet it never will be. I bet Prevail never does one damn thing, because they know the truth. They will milk it for a few more weeks, and fall back below the radar. Hopefully this will pay off for Prevail on a local level.
@andyspam85 Prevail is not doing this for publicity dude, its Hawaii we all know them over here. The song I believe was stolen legally. It is very common for bands to steal other bands music. Prevail made the mistake of not copyrighting their song when they made it. Lesson learned. I think it is pretty underhanded to say the least.
wow... checked out other songs from Prevail. They all sound like copies of other songs. Learn how to be an original band.. oh, and grow a set of balls and enable comments on your crap rip off video of Darling Parade's song.
Living on a rock makes it hard to get word out as a band, I feel it is a really low blow to steal a song that a band wrote from their heart then having it used as the song propelling another band forward in the music world, have you noticed the rest of their songs don't even break 1300 views? This is coming from Nashville TN the music capital of the world too. At this point it is giving credit where credit is due.
@prevailsucks really? Youre going to compare the "number" of fans? Prevail is on a rock, with limited spots to play, while Darling Parade is in the music capital of the country. They can go anywhere on the east coast in a matter of time with little money. While Prevail lives in paradise and it will cost at least $3000 to get their band to the mainland. Of course it'd make sense that they had more fans. Don't be naive.
Alright everyone, lets leave the hate out, obviously both sides think there right, but this is getting out of hand. Now im on Prevails side, but i dont think we should go around talking crap about Darling Parade, and Darling Parade fans shouldnt be talking crap about Prevail. We all need to learn how to respect people no matter what is going on, no matter what you're being accused of.
if this band was so kick ass they should have taken the tie to write their own motherfucking music instead of ripping it off someone else and trying to change it. thats low
@OldSchoolMusic666 Oh, they're kick ass all right. There are a number of things that could prove that, but I'll just leave you with this one: Prevail has a little over 800 likes on Facebook, while Darling Parade has over 18,000. Looks like PreFAILl is lacking a couple of digits. And it also looks like PreFAIL is just trying to market themselves. They should just stop while they are ahead, because they suck. Big time.
This sounds nothing like Paramore... or metal? what the hale?

if all you listen to is pop music then yes this is'nt going to sound like paramore, because you surround yourself in pop music you'll be able to tell the difference, but someone like me that listens to metalcore, progressive metal, classical, smooth jazz, underground hip-hop, RnB, Soul from the 60's and 70's, dubstep/filthstep, vocal trance, punk/ska, reggae/dub, and is so diverse in their music is going to say yes this sounds exactly like paramore.

Metal? This definitely isn't metal. Maybe alternative or pop-punk. There arent any palm mutes, arpeggios, sweeps, double bass, heavy vocals, guitar solo's, nothing resembling metal around here.

@misterbillg1990 Obviously you're out of the loop, yo. Many of the best bands are female-fronted.
eveningninja 2 weeks ago
@eveningninja you cant call a band a best band until they have tons of great critic reviews and are popular throughout the world. a more accurate version of your statement would be "i like bands with female leads" just because you like them doesnt make them a best band.
Sairyoku00Udemae 2 weeks ago
@Sairyoku00Udemae ...no. You are describing a commercially successful band. Being popular doesn't necessarily = best.
eveningninja 2 weeks ago
@eveningninja As for me, if I like the majority of their songs....then they are one of the the best band. XD
WhiteBloodMoon 2 weeks ago
@eveningninja commercial successful bands is the definition of "best" bands. the way your using "best" is just as an opinion. your opinion that bands with female leaders are many of the best bands is just an opinion, nothing more. however, bands like linkin park can be considered one of the best bands of all time since millions of people listen and like them. even if they made no money at all, they could still be considered one of the best bands, based on the millions of people loving them.
Sairyoku00Udemae 2 weeks ago
@Sairyoku00Udemae Of course it's an opinion, but it is still a more accurate description. Being mainstream has much more to do with marketing tactics than anything else.
eveningninja 2 weeks ago
@eveningninja to put it simpler for you, because you think female lead bands are the best bands , that does not actually make them a best band just because you think so. that is my point and the one im trying to argue. once you realize that then the argument is done.
Sairyoku00Udemae 2 weeks ago
@Sairyoku00Udemae There's only going to be one way "best" works in the case of judging music, and that is obviously subjectively. Why do you think I responded directly to misterbillg1990? I wasn't broadcasting this is a fact to the world.
Businesses marketing a band to be commercially successful has little to do with its direct musicality. As soon as you realize THIS, you'll realize you're arguing a different point that isn't even relevant to my original statement.
eveningninja 2 weeks ago

@Sairyoku00Udemae Quote>>considered one of the best bands, based on the millions of people loving them.
Quote>>because you think female lead bands are the best bands , that does not actually make them a best band just because you think so
Unless millions of people are thinking the same thing eh?
Doesn`t it also mean that just because millions of people think that the band is best doesn`t mean it`s the best band because it`s just an opinion of a million people and doesn`t prove anything?

It's been stated 'Prevail doesn't market their music' none of their material is available outside of hawaii...with this statement alone the entire argument is rendered invalid. The fantastic theory that Darling Parade magically found this song a year after they had written their own version is outlandish. These conspiracy scenarios are quite entertaining, but are as believable as the drunken rantings of an alien abduction theorist.
awaide88 1 month ago
@awaide88 Prevail has a myspace (lol, that site still exists? surprise!) and people visit hawaii all the time, so I'm sure CDs and videos have gotten around places. It probably IS unlikely, but the chances of Prevail stumbling upon DP when their first CD first came out are also not that big either. I'm pretty sure these videos werent all over youtube back in 2008 either.

s2thalayer 1 month ago
@finaleus My bad, I removed my comment because I read yours wrong. Prevail uploaded their version April 5, 2010 on myspace. Darling Parade had already recorded and federally copyrighted the song a year earlier. Not to mention, bands don't do big time recordings like Bells Are Ringing is until they have played it live a LOT. I would say this whole situation is unlikely, but the facts show far less likely that DP is to blame.
s2thalayer 1 month ago
@s2thalayer Okay, I can't say that I can deny anything you said in your comment. Prevail has played the song before the recorded as well, but you're right... from a perspective without any sort of bias, DP clearly has the rights to the song and Prevail is most likely wrong. I'm still not going to change my opinion, but that's how this will probably end (hopefully without a crapload of arguing).
I'm at least glad that your defense in DP is actually legitimate, unlike some of the other haters.
finaleus 1 month ago
@finaleus I'm a realist. I like to think I base my opinions on fact and understanding both points of view rather than pure emotion like a lot of our fellow youtubers. I wish this would all just end and Hawaii could have their Heart Beat and the rest of us can have our Bells Are Ringing...but I know it's too late for that now.
s2thalayer 1 month ago
If anything, Prevail is helping DP, because no matter who stole it, it is DP who is getting all the attention from this. There's no need to hate on the band that is helping DP get views. Did you notice the views on this vid have shot up since the whole ordeal?
Don't hate on either band no matter what you believe. Stealing sucks, but hating without actually knowing shit for yourself is worse.
finaleus 1 month ago
Can all of you DP fans calm down and look at this logically for a second?
If you stole another band's song that they had copyrighted, you would NEVER come back to them years later to complain about it. Prevail does not sell anything of their merch online, so they clearly aren't trying to get attention with this. However, if you found out that some other small band stole your song via facebook years later, I'm sure you'd complain too, whether or not you copyrighted it first.
finaleus 1 month ago
@finaleus Prevail didn't come at them, fans of Prevail brought it to Prevail. That puts Prevail in a spot to defend the song or lose all credibility. Maybe it goes too far and gets where it is today. That argument doesn't prove anything, much like all the other dead end arguments and logic everyone is trying to put together. The simple fact is, right or wrong, believe it or not, copyright laws were put in place to settle this exact scenario. It's how the system works.
s2thalayer 1 month ago
@s2thalayer I know that DP has the copyright for the song, and so does Prevail. They screwed up when they didn't protect their music... so if they're going to get hurt for it, then that sucks... lesson learned for them.
finaleus 1 month ago
@finaleus Dual ownership for copyright does not exist. Federal copyright overrules assumed copyright. A copyright that isn't registered federally isn't worth the paper it's not written on. But yeah, I agree with what you said. If they did in fact right it, they screwed up, lesson learned.

@Crusherle and no, it doesn't sound like Paramore. At least you're trying to compliment them, but people who always compare bands to paramore need to get their ears checked.
finaleus 1 month ago
@finaleus Don´t we all try to compare upcoming things to things that already exist? In my opinion this song could have been written by Paramore too. Paramore has it´s leadership in this segment of music, so it´s obvious to use them for comparison. And if you say DP does not sound like Pm, it´s just your opinion. Never the less Darling Parade wrote a good song. Let´s stick to this.
Crusherle 1 month ago
@Crusherle Not trying to argue you to the ground, and I respect you used "In my opinion". However, from a different point of view here, Josh Farro's guitars are (were) extremely simplistic. That's fact. These definitely are not. Zach Farro's drums were way different than this. Hayley's vocal style is night and day different. Darling Parade has a lot of country sides to their stuff, where as Paramore doesnt, even though they both originate from TN.

@bigboybeard It was an awesome way to get exposure though at someone else's expense huh? I mean, it'll cost them up to $30,000, or up to $150,000 if they knew they were copying Darling Parade's song when they did (extent to which the infringer disregarded the property rights of the owner). But I'm sure it was worth it.
s2thalayer 1 month ago 2
@rawkieee What is this dream world you're living in where copyright doesnt matter?!
s2thalayer 1 month ago
I have no way of saying who ripped of who - I'd never hear of either band before now, as I was linked from a third party. But I will say the arguments being used by DP fans mean nothing. Registering copyright means that no-one else has previously done so, but not everyone does register their copyright (it's automatic, registering just makes it stronger), and more popular artists have been known to steal off unknowns, because they can get away with it. Not taking sides, just saying.
MissGreyDay 1 month ago
@MissGreyDay This is not true at all. If this is what you believe, you need to study copyright laws a bit closer. Copyright must be registered and filed in the Library of Congress to exist. If not done so, you do not own your own idea. It is a simple process, and a common thing to think it is automatic but it, in fact, is not. Even if Prevail did write the song first, they do not own it because they did not register copyright. This is not opinion or debatable. This is the law.
s2thalayer 1 month ago
@s2thalayer I've got the laws up in another window. They state that copyright exists as soon as a work comes into existence (in this case, as soon as the song was written). It's just a good idea to register it because it makes it stronger, and gives you a better case if someone does steal it.
MissGreyDay 1 month ago
@MissGreyDay In order to file lawsuit, you must have a copyright filed in the Library of Congress.
s2thalayer 1 month ago
@MissGreyDay Therefore, you are half right. I minored in business law and I'll admit i didn't know copyright existed automatically. However, I don't get the purpose of even having a copyright if you are not entitled to statutory damages or the ability to file a lawsuit for infringement. Anyone who has the registered copyright trumps the other.
s2thalayer 1 month ago

Whether its a joke or you guys really think you're entitled to the song, DP has shown copyright. You are actually TURNING PREVAIL IN for copyright infringement.

WELL THEY BOTH RIP OFF PARAMORE SO WHAT DOES IT MATTER?!

@keithskookingklan
Why is it that every band with a female vocalist is automatically copying Paramore in some way?

Big time.

@OldSchoolMusic666 You should have taken the time to use spell check.
