The judge fails to realize the power of ambiguity in the General Welfare clause stated in the Constitution which says..."provides that the body empowered by the document may enact laws as it sees fit to promote the well-being of the people governed thereunder". I dont agree with the bailouts but the govt can certainly point to this scape goat clause to justify any action under any circumstance...

I always like hearing Judge Napolitano's constitutional viewpoint - it's such a rare thing to hear in America at a time when most attorneys and judges incredibly don't even learn the Constitution in law school.
However, it's better to hear the Judge without some Fox commentator interjecting, does Napolitano still get his own air time or have Fox executives decided to not let him speak freely?
