I suggest that my fellow veterans download a copy of Federal Form 4473 and read the definition of COMMITTED TO MENTAL INSTITUTION and then read the EXCEPTION to 11 f. NICS Improvement Amendments Act of 2007 if you want to know what I am talking about. I found it a rather interesting read. According to the way this reads I anot disqualified under my circumstances but then again I was denied in 2009. Now I am questioning exactly how the court reported this because the State will not show me this.
Your V.A. file is private at the moment, being 100% should not disqualify you for weapons purchase. He then called the Judge and told him I could possible be angry about this.
It seems a little strange that they would put into Alabama law that you can have this hearing once released but then make it nearly impossible to be successful. The entire process was a sham, the hearing lasted maybe 5 minutes and I was not given the opportunity to know what allegations were against me prior to the hearing, call any witnesses or cross examine any witnesses in support of the petition as Alabama law requires. As a matter of fact, the only one in the hearing was my ex wife.
I requested that the Judge allow me to have a copy of the Probate case file because I am supposed to be able to request a hearing to evaluate my competency to purchase a firearm to have this removed by Alabama law. The Judge refused and stated I would have to have a court order to get it. My attorney filed two motions to produce with the circuit court and both were denied. I spoke to the Criminal Justice Information Center and they sttated that it is almost impossible to have this removed.
Despite all this the Judge had me picked up and sent to a V.A. hospital for evaluation. I was later released as competent and no harm to myself or others. Regardless of this, the judge reported this to the Alabama Criminal Justice Information Center who in turn reports this to FBINICS. So, now I can never buy a firearm again for the rest of my life. I am a Desert Storm and Iraqi Freedom Veteran. I also spent 5 years as a contractor in Afghanistan supporting our troops. None of that matters...
In my case I had no police contacts yet my ex wife claimed I had been frequently fighting but I had no assault charges and she had no witnesses to this. She claimed I was not sleeping, eating, was yelling, cursing, moody and using poor judgment but this was my ex wife of 4 years. I did not live with her so she would have no knowledge of these things and listed no witnesses and who made my ex wife of 4 years the Judge of what is good judgment on the part of her ex husband of 4 years. Ridiculous
PTSD can be a serious thing, I am not telling you not to seek treatment, I am just telling you to insure that you are informed. V.A. records are private at the moment but legislation is out there where they are trying to change that from what I have heard. My case is special, in Alabama anyone can have anyone committed for evaluation and they do not need much to make it happen because many Probate Judges in Alabama tend to air on the side of caution rather than actually do their job and Judge.

My brother is a Marine veteran who served in Iraq through Operation Phantom Fury. He tried getting help from the VA, but he didn't get shit. He hates the war now, and the only thing that helped him get over his PTSD (for the most part) was Medicinal Marijuana. Helped tromendously.

I was part of a unit that went to Vietnam from New Zealand. PTSD was unheard if in Vietnam, as people were fighting for the free world. Many New Zealanders were Maoris, who bought back trophies of their kills, mainly skulls. One I knew was a Sergeant Major (like a Master Chief in the US). He used to polish the skull with boot polish. He said he loved the guy and said he died very bravely. The Maooris loved it in Vietnam. They loved the fighting.

Even though I had commited no crimes and had no police contacts, they picked me up and turned me over to the V.A. for evaluation. I was released as no harm to myself or others and competent which was no surprise. The big surprise came when I tried to purchase a firearm. Alabama reported this to FBINICS
