All of you morons who are saying "the FBI ruled" or the police needs a summons. No.
The Federal Court have ruled that you have a right to videotape anyone on the public way, for there is no expectation of privacy in public. If you're just standing there, out of the way videotaping, then you'er ok. The second you start yelling at the police, the suspect and or any bystanders, you are now inciting to riot and have interjected yourself into the situation. Yes. do this, then you can be arrested.
Exactly who do you call if you witness a situation like this,my brother did once, the cops that came explained the others were undercover and then they beat him up too. exactly who do you call ?
To ALL Cops: You can NOT confiscate private property without a WARRANT. You are breaking the law if you confiscate private property. You can NOT do what SCRIPTED TV programs portray. Read the 4th Amendment, the SUPREME law of the land.
It's about time that youtube allowed instant uploads..."you wanna confiscate my phone, sure officer, just hope you know I just hit up load. Now if you can shut down the entire internet than you can stop the world from seeing your misconduct"
THIS IS ILLEGAL!! The FBI ruled that it is FULLY LEGAL to video or audio record any police activity taking place in public, but not wire tapping, police radio, etc. Taking her phone and her is totally 100% against the law! They can't do that!
These pigs deserve the death penalty plain and simple. A message needs to be sent NOW!! Cops are the most out of control gang in the United States and I'm fucking sick and tired of it!
It is illegal to film or take pictures of police actioins. That's what gave them the power to arrest her. Thank God other people with cameras were able to get proof.
@melora72 Not in California. It's entirely legal to film police officer actions unless the recording presents a serious risk to the investigation. What the cop did was hardly appropriate.

Call 714-738-6800 and let the Fullerton Police Department know how you feel about this matter.
Officer Joseph Wolfe, Officer Kenton Hampton, Officer Kevin Craig, and OfficerJames Blatney are still employed by the Fullerton Police Dept. and aided in holding down Kelly Thomas while he was beaten to death
4 cops hold down Kelly Thomas so 2 cops can torture and beat Kelly Thomas for 10 minutes resulting in his murder. And only 2 cops are being charged.
4+2=2
That's how you do math when you're the Orange County District Attorney (Tony Rackauckas) and you're in the Police Unions back pocket.
Over the course of 8 years Orange County District Attorney Tony Rackauckas received THOUSANDS of complaints against Fullerton cops and didn't prosecute one cop; that's statistically impossible.
As of today, Sept. 21, the Orange County District Attorney charged 2 of the Peace Officers with "Involuntary Manslaughter, a felony". They could serve 4 years time.
@YosupMofo Stop it, will you do better research please. You keep posting that only "involuntary manslaughter" is the charge, which is not true. That is one of 3 separate charges for one, Ramos, who also got "second degree murder" AND "excessive use of force.' The second cop got 2 charges, "involuntary manslaughter" AND "excessive use of force"
@airforcemax They are NOT candidates for the death penalty, though brutal this was, this was not a planned murder. Not premeditated murder. That is when someone sets out and plans to kill another person. They did not. I'm not saying what they did wasn't wrong, it was very wrong, but calling for the death penalty is wrong too. It's not a death penalty crime.
@iamlost2 Being that these officers were familiar with Kelly Thomas (i.e. they had interacted with him before) who is to say that one or more of the cops were not waiting for the chance do him serious harm or eliminate him. I seriously doubt that this was the case but it could be brought up in a trial. .....if there ever is a trial. When these thugs are put on PAID LEAVE of absence; (vacation), usually someone is looking for a rug to sweep the entire incident under. It's called corruption!!
@iamlost2, These peace officers are candidates for the death penalty, as the father of Kelly Thomas was recorded.
Troy Davis is being executed for allegedly killing an off duty peace officer so why the standard - why defend people who know the law they are suppose to enforce?
@airforcemax No they are not candidates for the death penalty. Not in California, anyway. As for Troy Davis... he's dead now. I have doubts now that he even did it, there was not enough evidence to put him to death. Oh well, we live in a fucked up world.
The FBI is spending more resources searching for the hackers who posted nude photos of Scarlett Johansson on the internet than they are investigating the 6 Fullerton cops who tortured and killed Kelly Thomas.
Don't worry everybody, soon the citizens of Fullerton will feel safe knowing that these heinous nude pictures are no longer roaming the internet.
Keep it moving folks, it's just your tax dollars hard at work... as usual.
The City of Fullerton is paying $76,000.00 a month to the 6 cops who killed Kelly Thomas to sit at home and drink beer (stay-cation = stay at home vacation).
That's $12,666.00 per month per cop. Multiply that by 12 months and these cops make more than $150,000.00 a year.
These cops and their union are laughing at you the American taxpayer all the way to the bank; mocking you and calling you a sucker.
Maurice Clemmons was a hero. He was the gentleman who greased those 4 doughnut eating pieces of dog shit near Tacoma, Washington in 2009. This sort of thing has been going on all along, but this day in time virtually everybody you see has a cell phone with a camera in it. You can't lie your way out of something that's been videotaped.
The police can no longer be trusted to protect and serve the American citizens. They are a queer and strange bunch of hoodlums. On their off time they only socialize with their own kind and when they do speak to anybody else it is done in a sarcastic condescending manner. These worthless FREAKS are a serious threat to everybody. It is time that we form a "Citizens Defense League" for our protection!!! We need it, we deserve it! And whenever or wherever we see this happen, we fight back!!!!!
Ron is right .It is important for all to get on the same page. Difficult to do as everyone has a related but different cause they are promoting. Rights for the mentally ill. Police and abuse by the system. Homelessness. Transparency, Justice. We all need to remember we are many flags and yet one nation on this and need to work together. Bring your issues to the events and stand united with your support for Ron's family and justice for Kelly. One voice together will be heard louder and clearer.
I find it interesting that if you stand by and do nothing when a crime happens...like say 6 large armed thugs beating a homeless mentally disabled person to death..you can be charged under the "good samaritan law" for not taking action. Yet the "good cops" that stand by and just watch are not even reprimanded. Apparently all of the police have placed themselves above the law. Long past time we change all of that.
Does it take a horrible event like what happened to Kelly before people will look and help. Shawn Tischler has been missing for 81 days and 51 days since LBPD arrested him. KNBC Conan Nolan put his story on 6 o'clock news yesterday. The LINK is on the Media page at findshawnt website Help us to find Shawn before he comes to harm.
Our prayers are with the family of Kelly Thomas and all others who suffer this illness. We have a new YouTube/findshawnt video with pictures of Shawn Tischler. We want you to know who Shawn is. His voice will be heard and he will not go silently into the night as those who cast him aside wish that he would. Help us to find Shawn before he comes to harm.
Police need to get a summons to take property (due process) if they took a lady's phone, and took her behind a car out of sight by the description of these "cops" you might want to drag the river or go through missing persons to discover her ID. You know a "living" witness might pose a problem for them.
We are afraid of what may happen to my son Shawn in similar circumstances. It is very likely that his hesitation to respond to orders will be considered "resisting arrest" Shawn, is Schizophrenic and was arrested by Long Beach CA Police June 26th for no apparent reason. Shawn has not been seen anywhere since being taken by the Police. If he's still wandering the streets we pray we can find him before the police do. Please go to FINDSHAWNT on YouTube. We need your help and prayers
I am surprised the police haven't killed the woman of course, there is something called digital forensics which can recover anything from digital media. The FBI will be interested in that cell phone. Of course, the cops might have chucked the camera into a retention pond.

This applies to every law enforcement and the US military. We all make mistakes, that can teach for other peace officers can be avoid this behavior.
Law enforcement need to be able to have better interactions since they have vested authority and deadly weapons.
These peace officers are candidates for the death penalty, as the father of Kelly Thomas was recorded.
Study the law to always seek justice never revenge.
