Some asshole tried this shit with my father a few years back.. Cut down a fence & a few trees that he claimed were on his property as a result of a recent survey the idiot had done. Turned out that the surveyor wasn't real good at his job & used the wrong marker to measure from. ended up costing the surveyor & the moron about $60,000 in costs & damages at a boundary hearing, although it took over a year to get the matter heard. You should probably contact a fence-viewer, who has the statutory power under Ontario's "Line Fences Act" to mediate disputes amongst the co-owners of a fence situated on a property line. If he's satisfied that your neighbour has contravened the act, he can order an injunction stopping the removal of the fence, and he can also award costs for the replacement of the portion of the fence already damaged. You must remember though that this is a civil matter. The police are not going to get involved
