  • I think my comment is correct. The key word you are ignoring is "may" (or "might"). The standard declaration is "I refuse to answer on the grounds that it might tend to incriminate me." That's the only reason you have to refuse to testify.

    In any case, Goodling has no right to refuse to testify just because she doesn't want to, or because in some hypothetical future her statements may be considered false. All she has to do, of course, is tell the truth.

  • "Wasn't defined as a crime?" Hello! Leaking the name of a CIA agent whose identity is supposed to be secret is criminal! It's wrong!  It puts people's lives in danger.

  • O'Reilly is correct: If loyal Bush administration personnel testify truthfully under oath, they're almost sure to become convicted felons. There's a reason for this-They're criminals!

  • You can't plead the 5th unless your testimony self-incriminates. If she's trying to plead the 5th because she doesn't want to get caught in a lie after-the-fact as Billo is implying, then she should be locked in jail until she testifies. Besides, she can't plead the 5th for her entire testimony, it is only pertaining to specific questions which relate to her actions that the 5th can be invoked. So, either her lawyer is a complete idiot or she thinks she did something illegal already.

  • Her lawyer is one of the top guys (famous for the Dowd Report on Pete Rose), so your second choice is a lot more likely.

  • Bill O completely misses the point. She CANNOT refuse to testify just because it may be uncomfortable to tell the truth. And of course she can avoid Scooter Libby's fate very eastily (hint: tell the truth).

    The Fifth Amendment provides protection against "self-incrmination," which means the ONLY reason she could refuse to testify is because it may provide evidence of a crime she committed.

  • If she takes the fifth, she's saying I may have committed a crime. Otherwise she has to testify or she'd be in contempt.

    Actually I think she's shadow dancing with the committee. She probably wants immunity, which personally I'd give her in a second.
