YES, the states which recently voted down SSmarriage voted in Obama, but at the time that B+W marriage was legalised these states would have voted that down, just like SSM is being voted down now. His argument will have no validity until 50 years or so, THEN if it is still being voted down he will have a slightly point (although still a bad one as minority rights should not be up for vote). The courts pretty much always lead the way in civil rights, this is no different.

  • Frankly, kenzieknights, how the hell does it affect you personally? No one is going to give up. If anything, they're more fired up about the future of the movement. If you look at the exit polls, the young voters overwhelmingly voted no on prop 8, so the future of the country is in the hands of those who support equal rights for all. It's going to happen. You're going to have to learn in a world with people who aren't exactly like you.

  • Great point that it has been "redefined many times". The issue that the opponents of equal rights (aka gay marriage) have is who has the right to affect social change. People like this guy want to exclude gay people from the equation altogether. Wasn't marriage originally a contract that would give the husband ownership of a newly acquired chattel (ie: the wife)? I think traditional marriage has been abandoned and transformed many times since its inception.

Coretta Scott King (God rest her soul) stated that we should make room for our gay brothers and sisters, I only wish that more people would open their eyes to the hatred, ignorance and injustice surrounding this sad day, when history was made and Obama became Pres. Elect, our country also took a huge step back in civil liberties.

    The religious rights of gay-positive churches (like the Metropolitan Community Church in Toronto that started gay marriage in Canada) must be protected by the state. Equal civil rights are for every citizen.

  • There's nothing wrong w/ it though. I'm for state measures to implement law. Yet, if its not legal than the law needs judicial review. Perkins wants to silence this process, which needs to be reviewed. Gay marriage is an issue that I see going to the Supreme Court. Bloom was good to cite The 14 Amendment and State Law as well here.

  • Boycott Utah. If the Mormons want to spend over 20 million dollars telling the people of California what they can and can't do, people who are supportive of gays need to boycott Utah. Maybe next time the Mormon church will think twice about telling the rest of America what they should do. I've visited Utah twice- never again. No more ski trips, no more visiting Arches, etc. Hit 'em where it hurts- in their purse. And I hope the gay community continues to protest outside the Mormon churches.

  • I have first-hand experience with "un"-equal treatment under CA's Domestic Partner law, which allows DPs the right to act on behalf of their partner:

    My DP was incompacitated & had filed for short-term disability with the State of CA. He received notice his claim was being denied as incomplete, so I called to find out what other info the State sought. Although I identified myself, CA refused to speak to anyone but my DP or "his wife." It was CA's law, & CA was breaking it!

  • If Proposition 8 is allowed to stand, some anti-gay faiths and churches will dictate whether the State and certain other churches are allowed to call gay unions marriages. If you belonged to a church (such as the UCC & MCC) which felt gay marriages were just, would you want the gov't or the Mormons to dictate your church's religious expression?!

    If Proposition 8 is struck down, no church will be REQUIRED to change it's religious expression.

    I completely agree with this. I found it ironic that some Prop 8 supporters felt this was a "freedom of religion" issue. It was the opposite.

    Before Prop 8, churchs were free to marry whomever they want. Or not marry whomever they didn't feel was appropriate to marry.

    Now, Prop 8 (if its allowed to stand) restricts religious freedom of a church to marry same sex couples.

  • Yup, in the last election, people under 30 overwhelmingly opposed Prop 8. People between 30 and 65 were split. People over 65 supported Prop 8.

    Even were civil unions to specifically encompass the same enumerated rights & obligations of marriage, the two things would still be unequal in practice, as were the "separate but equal" accommodations in the South. The very act of having separate unions or separate drinking fountains sets up an "us & them" or "better vs. lesser" paradigm.

    I don't know if you can't or won't understand. What I DO know, however, is that the concept of "separate but equal" is oxymoronic: making groups separate under the law renders them UNEQUAL in actual practice. The Supreme Court (in Brown vs. Board of Education of Topeka, Kansas) stated that very thing, and thus struck down the legal concept of "separate but equal." If the word "marriage" means so little to you, why not let everyone use it?

  • More than 1,049 federal laws in many categories including Social Security, welfare, veterans, taxation, etc. are based on

    the man-woman marriage relationship. All of these things will not be available to gay couples in Arizona because they cannot ger married. They cannot share health benefits, they cannot get their pensions. That's the difference. It's disgusting to seperate human beings from other human beings because of who they love.

  • After reading the California Constitution, I'm fairly confident Prop 8 is going to be overturned in California. You don't have to be a lawyer to see that it's clearly illegal and non-binding.

  • Actually civil unions don't hold the same weight as marraige. Thats why many people are pushing for the federal government to jump in and repackage civil unions so that they cover full rights. To me, civil unions are basically seperate and unequal. Gays should be given the right to marry.

  • i just had an argument with zennie62 who said the reasons why prop 8 was defeated was because it wasn't worded properly for black voters to understand.

    i countered with the fact that blacks can be just as bigoted as whites (in this case was the truth) for which he called me a racist.

    i too believe gay marriage will be made legal, not just in my state of massachusetts, but in the entire country via a supreme court decision. separate but equal is not equal by any stretch of the imagination.

  • It was titled "eliminates the right to marry for same-sex couples" and it stated "Only marriage between a man and a woman is valid or recognized in California." There was nothing confusing about the ballot, the ad campaigns managed to mislead plenty though.

    I think it's more racist to suggest a black person can't read as well a white person myself.
