  • Something everyone sems to have overlooked is the medical side of things. Cholera, typhoid, toberculosas, aids, hepatitis etc. As a country we have a RIGHT to protect our borders. This might not be the best way but, if we believe what we hear, detention in Auistralia is 100 times better than what they are running away from in their original country. .... and everything they get here is paid for by AUSTRALIAN taxpayers..Its no that bad and if it is then keep on sailing to En Zed

  • @bushpigification Hi just so you know, it's actually not against the law to enter by boat. It's allowed for in Australia's Migration Act as well as in International Law.  It is long established that it's not illegal to arrive by boat.

  • @jet1231982 Just so you know, detention is not a punishment for arriving and seeking asylum. It is merely a process. In as much as quarantining a person infected with a dangerous and infectious virus is not a punishment for getting sick. They are both merely processes to ensure public safety.

Mandatory, indefinite detention is not a process - especially where there is no prospect of ever being released (see Al Kateb v Godwin [2004] HCA 37). In Australia it is highly punitive, and aimed at people arriving by boat, despite the non-discrimination clause in the Refugees Convention and the provision for unauthorised arrivals in Australian law. Also, there is no correlation between detention & public safety. That is an illusion.

The UN has absolutely slammed Australia for its detention practices - both the mandatory / indefinite detention policy AND the shocking conditions in detention centres.

  • @bushpigification The right to seek asylum is granted in the the Universal Declaration of Human Rights and the Convention Relating to the Status of Refugees both of which Australia has signed to. At no stage is there any law opposing or any punishment imposed for seeking asylum. Australia would be violating international law if that were the case.

    Hi there, I am a young woman who lives with 3 young Muslim refugee guys who are the most hard working, conscientious people I've ever met. They care deeply about their families and they work their butts off to make sure they are contributing meaningfully to Australian society. I'm a Christian and they have nothing but respect for my religious decisions. What a pity you can't do them the same courtesy.

  • @Celtic450 of course you have a right to that opinion, but can you also acknowledge that it is so far fetched as never to happen? Do you ever ask yourself how Australian aborigines feel about there being so many white / european migrants that "they get a critical mass and change things"?

    Refugees from Afghanistan, Iraq and Sri Lanka face terrible persecution based mainly on their ethnicity. I am happy to provide more information if you are genuinely interested in knowing more.

Refugees should stay in their own countries OTHERWISE people in the countries they are running to end up as REFUGEES and have to leave for somewhere else as over crowding crime and welfare fines take their toll and wages are lowered and the cost of everything goes up.

  • @jet1231982 Few people oppose immigration. Nor legitimate refugees. Most people recognise that its our duty to, as a international citizen in good standing, accept legitimate refugees. The fact that refugees are hard working has no basis for the argument. It doesn't matter even if they're a burden (which is not the case). We accept people running from legitimate persecution not taking into consideration what they can contribute. Its a life saving exercise, not a money making one.

  • I dont think they deserve to be locked up for years at a time. I think they should be given medical checks and background checks and released. To be so ignorant to say they should be sent back or deserve to be locked up is just cruel and not the Aussie way. On your way to work, at work, during your lunch break look around and see all the immigrants that make up our beautiful Country!....But Australia has been doing this despicable shit since the early 1900's.   • The issue has nothing to do with muslims. Post here crime stats where the majority of purportrators of assults and rapes in our capital cities are of Muslim origin. In fact muslems make up such a small percentage of our population, they'd have to be a real extremely violent culture in order to outnumber crimes perpertrated by white Australians.   • RE the movie, what I would like to know is, does the film pose an alternate course of action for Australia to take? Australia has the right to screen its migrants and ensure its safety. It is perfectly legal to seek asylum via boats, but it is also perfectly legal to screen those people.

  • Putting them in detention, however, implies that they have done something ILlegal in entering the country. Screening does not have to involve detention. Most Western countries do not operate this way.

  • Most western countries don't have Australia's level of security proficiency. I don't like the concept of detention for asylum seekers, but how do you stop terrorists or undesirables from applying for asylum and then buggering off once they get to the non-restricted facility they have to be in to await their checks?

    The pragmatic solution seems to be to ship them to someone else's refugee camps until they are cleared to enter the country. Or hand operation of the asylum process to the UNHCR.

  • You don't. You take the risk like most other Western countries, and if people end up running aground, then you take appropriate action at the time. The crime of entering a country without documents is not, in my opinion, tantamount to rape or murder or theft or any of a multitude of crimes that Australian citizens commit every day. Anyone could be a terrorist or an undesirable, whether they are born in Australia or Afghanistan or Somalia or Canada.

  • Every other method of entering the country contains a check. The murderers, rapists, human rights abusers and terrorists would use the open door to enter the country, and then skip the check. Those who know they won't pass the security check will run. You can't ask a society to open its doors to something like that. The check needs to happen, the issue is how to incorporate it into the procedure. It doesn't matter where they're from, they still need to pass the security and other clearances.

  • I often wonder about opposition to detention by asylum seekers. They're not abused, just detained and generally in conditions superior than in their home countries. They're fearing persecution, in fear for their lives. Shouldn't being protected and cared for by Australia for free be enough? If I was running for my life, I'd be happy to just not die. Rather than bothering with the time taken to do security checks, during which I'm housed and fed for free.

  • @sdarvell Hi - yes I agree that a period of detention to make sure of identity, security, medical checks etc is necessary. The problem is that in Australia there is a policy of mandatory, indefinite detention, where an innocent person can be kept in detention for the rest of their life (literally) without ever being accused of a crime.

    Also there is a huge body of evidence that there has been terrible abuse in detention centres in recent years. If it was brief and humane detention it'd be ok!

  • @jet1231982 Indefinite detention only applies to people who will not return and are not deemed to be legitimate refugees. I can no see a way to avoid indefinite detention, unless the government forcefully violates the free will of the refugees. RE abuses, they are over dramatised. Australia is an industrialised nation with a rather transparent system of checks and balances. The UN clear our facilities and the red cross monitor actions. An abuse claim in that environment is absolutely specious.

  • @sdarvell, You have the air of someone who knows what they're talking about, but you are definitely misinformed on some things! Many people were detained for 2-6 years and THEN found to be genuine refugees. The prob with mandatory / indefinite detention is that there is no filter.

    Abuses in detention are not dramatised. I have been to Villawood, Baxter, Maribyrnong and Broadmeadows detention centres hundreds of times over the last decade, and the things I have seen are shocking.

  • Check your facts, you will find that more than 95% of those detained for attempting ILLEGAL entry into this country have previously tried through official channels and been refused, hence the reason for the ILLEGAL attempt.
