The sampler's reps then said that they were within their rights to NOT pay the original creator, because they had "used" not "taken" a small "8 bar" section and turned it into a "completely different creation". THEY JUST REPEATED THE SAMPLE FOR 8 MINUTES!. How about putting up the same piece WITHOUT THE SAMPLE, and see how well it holds up, if the sample was so insignificant...THE SAMPLER (THIEF) LOST THE CASE, BTW!! Don't be so sure you know what's going on! I had to testify, so I know!!
Don't be so sure that ZZ, or Lamont was paid for the sample. I have several friends that have recorded for major record companies, with major hits, and they have had songs sampled without their permission; even when they had not been clearance for the sample to be used. They then did not have their names listed for the sample or the performance of their production, singing, voice, etc....AND THEN, their lawyers, when they were being sued for it, attempted to belittle the original creation.
Credit where credit is due, and acknowledging the source, and hopefully monetary compensation would be in order also...Yes, it does take great ears to recognize great music, and even hear nuances...I have no beef with hip hop artists finding new points of view.
I listen to it...that's how I know that it exists...I think most of us can listen to a piece of music and recognize that it is great...The real magic is creating something from the ether, not grabbing someone else's creation, and claiming credit for creating it...and i have created tons of material of all genres...jazz, r&b, hip hop, country, classical, pop, rap, i just do mine without sampling someone else's work, or when i do, I give full credit to where I gleaned it!

Some of the hip-hop artists have even gone as far as to take credit for sampled music, calling it "MY MUSIC". Kanye has even been quoted, bragging about being at the top of the music industry without any musical knowledge or being able to play an instrument or being able to sing!

Nothing wrong with sampling when you create your own unique version like Madlib did on Madvillain. This man's singing was KEY for that song.
Added so much soul to that intense, crazy album. Madlib and Doom, what a perfect chemistry.
