The harsher the punishment, the more of a deterrent it is. If you reduced the punishment for murder to a civil infraction with a $100 fine and guaranteed expungement after 90 days I can guarantee you murder rates will skyrocket, especially in violence prone areas.

Why? DPRJones contends that the death penalty is not a deterrent to murder. It does not follow that removing it must reduce the murder rate, it is only necessary to show that murder is unlikely to increase. And that is exactly what the statistics do show.
I don't think that DPRJones point was the the death penalty INCREASES crime, just that it can't be the opposite if the areas with one have higher instances of violent crime

The way to prove THAT is to take a state with the death penalty, remove the death penalty and then see if violent crime decreases.
